Are PDLs trying to help or scam?

Back in 10/05 I got a $200 loan from PDL named Westbury Ventures. It was agreed that finance payment would be $60 per pp until they got word from me to take loan amount plus finance amount ($260)and be paid in full. The first debit was indeed $60 but they debited my account for that amount plus additional $90, then $30! I stopped payment on all of if and contacted them about this. They were not trying to listen to me and kept trying to take addtional amounts from my account that were not agreed upon. I finally had to change my account number and now they are threatening me with legal action. I told them what happened and they wanted to make a "deal" with me to pay less than what is owed and to send it by Moneygram because that was the "only" way to not have legal action against me. They did not try to address the addtional attempts of debiting my account for extra monies. I do not deny I owe initial loan and finance charge however I am unable to secure address where I can send a money order and have this over with. Any ideas? They are bugging me with phone calls....Oh, thanks for your response.

This is the problem with most payday loan companies. Especially when it comes to internet based payday lenders, it makes tough for consumer to deal with. Which state are you from? All the states have different regulatory laws for payday loans and lenders may not charge fees or penalty or extension cost more than what has been stated in the statues.

I have dealt with a few PDL's myself. Seems like every time I spoke to them, my % rate went up ( owed more money than they advertised) Was really frustrating. I think PDL's are mostly a scam.

Ok..my experiences!! LOL I did get tthree or four of them, at one time. I just couldn't keep up with all of them. And, of course, if u are making a late payment on them, the % rate goes up on the loan. Just too many! Some I haven't paid off yet..turned over to collection agencies. However...a Payday loan will not be on your credit report.....the Collection Agency ( in which the Payday loan was turned over to) will be on your credit report. Hope that makes sense. If anyone is having this problem, just remember, the CA will report you are deliquent with them ( the agency, itself), ..not the PDL they are actually asking money for.

I have a "lawyers" office calling me to which they say it is from Paul Kouperstein and Associates in Canada (where I am from). I have a pay day loan in the amount of 500.00 it has since escalated to 800.00. This " sargent" guy tells me that I have to pay 800.00 by noon today or else I will be charged with fraud and also be sued.
I tried to tell him that I will pay it down in installments, he basically laughed at me and advised that there are NO arrangements that can be made and that I have until noon today. Well, noon came and went and I didn't comply. I couldn't.
I have no idea how to proceed from here. Is this a scam? I contacted the payday loan company and they advised that it is out of their hands to deal directly with this "lawyer"
They have my old address, do I submit my new address in the event they would need to send me papers?
Any insight that could be provided would be greatly appreciated.

Hi,

Please do not be scared of empty threats. When did they contact you? Is the debt yours? Even if it is your debt go ahead and ask for debt validation. Send it via registered mail. Keep copies of all transactions with you.

This can be a scam. Read the debt forums for more info about the law firm. File a complaint with the BBB.

You are saying that even if you want to pay the money off to the payday loan company they are not taking it back? GO ahead and ask them whether they are willing to receive any payments or not. If possible interact with them only not the debt collector.

Paul Kuperstien is a controversial company so be on your guard.

I tried to negotiate with this person to make arrangements and he out right said no. It is the way he stated and that is that as far as he is concerned.
I went directly to the PDL store and they said that it was out of their hands and I can only deal with this "law firm". I honestly don't even believe that they are a law firm. I can't even get an address from them unless I agree to pay the amount they are stating. It was 800.00 up until noon yesterday, now its 2400.00.
You have heard of Paul Kuperstein?
Since they have my old address and in the event they do file court papers, they obviously won't reach me, therefore, won't a judgement be issued therefore enabling them to garnish my wages/seize my bank account etc.,?

Any insight would be greatly appreciated.

If you check Ontario law...they have to first send you a paper copy called a debt validation and cannot contact you until 6 days after they have sent it. They are not police and cannot charge you with fraud. They are fraudulent. check under Paul Kuperstein and assoc. on the net and you will find many forums regarding thier false schemes. Don't send them any money until you get the debt validation. So far anyone who asks for one ....gets an earfull...some threats...and never hears from them again.
I have had the same call on Friday and have to pay by noon today. I will be calling them and asking for the validation....good luck!

What PDL is this, GUEST? I DID deal with a PDL, some time ago, that was set up in Canada. When I signed the contract ( VIA the Internet) the contract stated I had to "abide by Canada Law with this loan." However...I did default on the loan ( several reasons why) and a so-called 'Lawyers' office called me about it. NOW..the PDL, NOR the CA that is supposely taking care of this, is not on my credit.

I also received a call from a foreing person claiming to be a sargent with Law & Justice. Said he was going to file a claim agaisnt my SS# from a loan I had forgot about. Said I had to fax a statement saying he could deduct money from my account. What should I do?

When I was having trouble with PDL companies, I actually had a 'rep', from one of the companies, say, "he would be at my door, within hours, to have me arrested." This was almost 2 years ago now. I really don't know how a CA can LEGALLY take a 'case', concerning a PDL, when the lawyers know that most of them are 'bogus'.

This who PDL is a scam to set you up to be robbed I can see how they do there advertisement because they r robbing the black community they have a advertisement on black radio advertise that bull S--- on the white radio stations. This was the worst thing that i could have done. I should "ve known better. Anyway I got a $200.00 loan from pdl now, And it was paid in FULL Jan. 8th , 2010. I am recieving phone calls , the guy is telling me they are gonna press charges( check fraud) against me. He tells me that the loan is not paid for ... they dont have a reference number on file. Well, i have gone threw my bank statements n THE LOAN IS PAID IN FULL. But, they keep on calling. What they dont know is that they messed with the wrong person. I work Vry Hard for the money i get , n I will NOT let some Scammer ...Scam me, My question is , what can i do to get them to stop calling my phone? I do not answer the phone for unknown callers anymore... BUT THEY JUST WILL NOT STOP CALLING ME>

Hi SKJ,

Can you tell me whether or not you have the payment receipt? As you know that you have paid off the money, you can send them a certified Cease and desist letter, mentioning that you are aware of your rights. As you have paid off the debt, they are no longer supposed to harass you. Mention that if they fail to comply to your request, you can sue them under the violation of the rules of Fair Debt Collections Practices Act (FDCPA).

Hi, RED. You can 'search' PDL's on the Internet and see if they are illegal in your state. I don't know, right off hand. However....I know the Experts, on the Forum, know the answer. One of them should be along shortly.

It seems you are making your comment toward a specific PDL. However..this is not a PDL company. This is a forum which helps people deal with their credit issues. PDL's can't have anyone arrested.

I actually got a loan last week and it's not due until this Friday. Already I have received threats from a lawyer. Literally a threat! I called him back after he told me the police was picking me up at 11:00am tomorrow. I called the police and made a police report and also contacted the BBB. They are full if it. I am now closing my account. Everytime I call them the lines are always busy and now the so called lawyers keeps hanging up ever since I told them about the police report. The money isn't even due yet so that emmidiately threw up red flags. I'll pay them but I refuse to allow them to debit the money from my account especially after reading these reviews.
