Debt validation after judgment

I recieved a threatening letter from a creditor, did request that they validate the debt, while waiting for that to come..recieved a summons to file an answer with the court, but it had no date on it...I honestly thought that they couldn't do anything in court until the debt was validated...I requested it on May 20th, July 25th I got a letter in the mail from the creditor stating that they had just recieved my request to validate the debt along with a copy of the judgement against me...is it too late since there seems to be a judgement, or can I still do something?

Did you send your request by certified mail and asked for a return receipt? Matters as important as this must always go via certified mail. You must have a receipt of when you sent out the request.

Well Tk, you could try to vacate a judgment if you think it isn't fair. This means you file a motion to dismiss a judgment if you think it isn't fair.

Hello and welcome. Did you not file a response with the court when you received the summons? Even if it did not have a date the first thing you should have done was went to the court house and filed this response. If you did not then they got a default verdict against you. Like Carol said you can try to vacate the judgement. I am not sure if there was a time frame you had to do this in. Call the courthouse or go down personally and ask what can be done at this point to vacate the judgement. At this point they can legally attach your wages and bank accounts.
If you can not get the judgement vacated you may want to make repayment arrangements with this company before they enact any of the above actions. Good Luck.

BE SURE to document ALL your correspondence and contacts regarding this case.DO NOT use email, or fax. The story will come back that"we have no record of your claim". Although your fax may have a date and fax number stamp,they will calim that they have not received it.Remember, you DEMAND proof of debt, and assignment of same to the collection agency. Good Luck.
