I read in the newspaper today I have been summoned. That's all I know. Can you tell me what I should do next? I'am a Disabled VET, and my wife as severe COPD. We are on a fixed income. Can they garnish our money for credit card debt? THANK YOU..

You should go to the courthouse and get a copy of the paperwork, maybe you still have time to answer the summons, then maybe you can make a payment arrangement that is workable for both of you with the company.

If you don't go to the courthouse and make some type of appearance on your behalf then they will be able to dictate what happens through out the entire thing, you should go and represent yourself at the least.

Hi Richard Fennell

If you receive a summon you need to go to the court house.

We are on a fixed income. Can they garnish our money for credit card debt?

If they get a judgment against you they might garnish your account. There are of course few exceptions. Your SS benefits will not be garnished if tyou receive them directly. However, if you have your SS benefits deposited in a savings account, that money may be garnished.

And like goodnatured said if you don't visit the courthouse they might get a default judgment against you. Arrange for someone to take you to the courthouse to be able to collect the paper works. Read the instruction on the summon papers properly and do as said to avoid any default judgment against you. Be at the courthouse on the day you have been summoned and you will get a chance to defend yourself. Don;t mjiss this chance and prepare well.
