Subject: Credit Card Help

Posted on Mon Aug 10, 2009 11:57 pm

Hello, I've been dealing with a single negative issue on my credit report for a long time now. It was a fraudulent credit card debt by Citibank, which has been now bought by another debt collector, Asset Acceptance. I have disputed the account via online disputing methods.

Out of the blue,I was handed a summons, (to which I didn't sign anything), and on the summons it says:
"You are summoned and required either: To file your written appearance by yourself or your attorney and pay the required fee...at or before 9:30am on August 17th"

My question is A.) What do I file? Am I going to have to appear before a judge on that date? B.) I have never been contacted by Asset Acceptance nor do I have any documentation of their collection of this debt.

I have pulled my Experian credit report, and Citibank doesn't show up there. There is a date of when Asset Acceptance opened this account which was 6/2006 but in their summons it states Date of Delinquency was 6/04? How do I find out what the SOL is?

I would appreciate any help/advice with this matter.

Hi fred

1st of all, don't opt for online disputing systems too much. Dispute a debt in writing and send it through certified mail. Some things work better the antique way.

Yes.

2nd, do not ignore a summon. I would suggest go to court and place your case in front of the judge. You will be given a chance to defend yourself in court. Get your papers ready. If you feel the need to then hire an attorney.

In the meantime you can write to Asset Acceptance and dispute the debt. If you need a sample letter you can find it in this link below:

Do let me know what happens

There's much more to choosing a credit card than learning which ones offer free giveaways for signing up. Shopping around for a credit card can save you money on interest and fees, which can vary among credit card issuers. Most issuers offer several kinds of cards, including its gud try it
