I receive multiple calls from the same creditor daily, now when I speak to someone(BTW: I lost my job so can't really pay at this point) I tell them whats going on. However through out the day I will receive three to four more calls from the same creditor..can the do that? I just want to know what makes the company who is calling me repeatedly thinks my status will change in two hours.

Repeatedly calling you is considered harrassment, you need to visit your states attorney generals page and find out how to file a complaint against them. Sounds like they need a lesson on proper debt collection, no one needs to go through this type of harrassment and it is against the law under fair debt collection law.

Hi MeanSecurity,

According to FDCPA or Fair Debt Collection Practices Act regulated by FTC (Federal Trade Commission), no creditor or debt collector can harass a debtor using any kind of unfair means. It is advisable to lodge an official complaint against the harassing creditor to the attorney general office of the state. The state attorney general’s office will guide you through the entire process. You can also file a complaint against the harassing creditor to the FTC where they only record the complaint.

Hi MeanSecurity,

Send them a cease and desist letter asking them to stop calling you for the debt. I can give you a link from this site that might help you. Here it is:

If you can negotiate with your creditor and get in to a payment settlement, I would suggest you do so, because you acknowledge the fact that you do owe the loan. Is there no way you can pay up some amount to make them happy? If yes talk to them.

If it a debt collector/third-part collector, DO NOT pay THEM... You should work to pay the original creditor, wherever possible, assuming that's the route you choose...

Well its Chase, I don't mind that they call me once a day..but after I speak to someone and tell them that I can not pay at this time due to my lack of income, I will receive up to three or four more calls through out the day. Its annoying, and I will do so with the Complaint to the A.G. Office.

Well I tried to file a complaint on my States website with the A.G. however the site wants me to first pick a category before I can send any type of complaint or email. Also I went to the FTC website(I don't know if its regional, or local) but the form to file a complaint has been taken down and I can not file anything with them as well. Guess I'm just that Lucky eh?

Anyways, I want to thank everyone for their help and input, but I guess I'm just going to have to deal with this my way..I.E. calling them morons and such after the first call lol...probably won't but would be nice to just lay into them.
