car loan charge off

I to have a car loan charge off. I have a 0 ballance with Americredit. They do not want my money, the car was charged of in early 2008. A recovery service came to pick up the car on labor day. They did not have a repo order, they simply wanted me to volontarily hand it over. I asked the young man for his biz card and he did not have one on him. He told me the ph# of the Co, he works for. I went into my apt and I called his Co. The lady I spoke to would not tell me who or what colletion agency she represents in the recovery of the car. I stated that I needed the ph# so that I may be able to work out a payment solution. She refused to give me the information. So I refused to give my car keys to there employee. He said thank you, call us if you decide you want me to come back and pick up the car. ? Does the recovery company have any leagle right to the car ? And if so, why did they choose not to exercise that right?

Probably they may send you a legaly notice if the bank sold your loan to them and charged off the difference

Hi Slow Eddie

Good that you didn't hand over the car keys to them. Even if they were legitimate (the chances of which are almost nil) they cannot simply ask you to give them your car with no proper documents.

Who do you have the debt with? I hope you have their details. Why don't you call them and seek a payment settlement with them directly?
