How to notify court of a bankruptcy

I notified a creditor I filed for Chapter 13 bankruptcy. Two days later, the creditor filed a lawsuit against me. How do I notify the state court of the bankruptcy proceedings? I have to respond to the Summons. Thanks!

I believe that you will need to answer the summons so you are not getting caught up between the bankruptcy being finalized and the summons being taken action on. So, answer the summons and then provide the court and the creditor taking the action with a copy of the bankruptcy paperwork.

It is your responsibility to inform the one suing you, the court will not do it for you.

You could also contact they attorney that represented you they can lead you in the right direction. I have to do this quite often. I had a creditor that took me to court after I filed chapter 7 and they told me what to send to the court and I didn't even have to go. So it may end up being that you will only have to send them a list of your creditors with them being listed. I know with mine the creditors are not even suppose to contact you much less file a lawsuit. Contact your attorney.

That makes sense debra, afterall you are paying the attorney to do the paperwork.

And a lot at that. I filed in 2007 almost 3 years ago and I still call my attorney if I have a problem. And they always help me.
