Subject: Please help with place called Elite Process

Hi,
Today I received a letter in my door from "Elite Process". I was wondering if anyone has ever heard of this collector? It is a short paragraph basically saying to "contact Bill within 24 hours to verify I received this notice and to schedule an appointment to pick up legal documents." I read a little on Elite Process and it looks like they are hired to track down accounts? Can they serve me a summons? My largest balance is for $6000. Should I call, Bill? Thanks for any help, am really confused on how to proceed. Rob |

| Normally a summons is served by the sheriffs department, but I would wait and see what others have to say about this, I have never heard about this company before, they may be a new service. |

| I have actually never heard of a company delivering debt notices to the door. You are correct usually summons are delivered by sheriffs. With all the scams going on out there I would be very careful. If no one here knows anything then I would try to do an internet search. The other thing you could do is call your Atty general and inquire about these people. Can you tell us your state, age of the debt (mainly last payment), and any other ifo so that we can help? |

Yeah I'm still not sure what to make of this company. Heres a link to what I think is their website. Very skeptical to me as if you look a the contact information there is a hotmail address? Its also states its based in Austria but track people overseas. As for debt:
I lost my job awhile ago and havent payed my credit cards for about a year and 3 months now. There are about 6 of them with balances ranging from 1200-6000. I'm trying to settle (using unemployment as basis) for around 15%, one at a time, but have never seen anything like place called Elite Process. I also live in Michigan in a real small town, which made the form in my door that much weirder, as I tracked the phone number to a person several hours away.
Again the note in my door just says: "Be advised we are attempting legal service of process upon you. Please contact Bill with Elite Process at (local phone number to me), within 24 hours to verify that you have received this notice and to schedule an appointment to pick up legal documents. Your attention in this matter is expected and appreciated"

The place based in Austria seems a bit of a longshot now. I found this place listed which is about in the yellowpages. No website though.

These type places seem to be middlemen for collectors trying to serve you documents. I'm hoping its just a compliant and not a summons at this point. Although just living on unemployment with no home (rent apartment), I dont think theres much they can take at this point. |

| a summons is when they actually take you to court or the threat is there for them to take you to court unless you work something out with them. |

| It still does not explain the difference between a complaint and a summons, what is the power or purpose of a complaint, what are the reprecussions of not acting on a complaint. There are many answers here on summons, like they will get a default judgement, but what about a complaint. |

I was under the impression that a complaint is another version of a warning. If I do not respond to the complaint, a summons may be imminent. I could be wrong. Either way, I dont know what kind of document they have for me, as I have not contacted the guy who left his number. Seems real sketchy with just a first name, no account info, and unlisted phone number. I have a couple settlement letters out there now, so I'm really hoping those slow down that kind of activity (people at my door). We'll see what happens. |

Gotcha, then they should not call it a complaint, should just be an "intent to sue", that is pretty much plain english and easy to understand.
Do you think that this is another way that collection agencies co erce people into paying debt that is not really collectable, I could see this being used for a tool to do that type of collection activity. Usually if one uses it and it works then you will see the others follow suit, we will have to keep our eyes open to this and then find a way to deal with it. |

| Good natured, I recieved a phone call from a collection agency informing I needed (or my atty) to contact them concerning a complaint filed in their office. Of course hearing all this formal talk made me nervous and I called. They informed me that the "complaint" was a creditor trying to collect a debt and if I ignored the complaint a lawsuit would be brought forth. I believe they use this word to intimidate and scare a person. My advice would be to send a debt validation letter immediately after they contact you. |
