Subject: After payment or settlement can they still sell your account

| I settled an account for my son who is in the marines about three or four years ago. I paid thru a collection agency and they accepted. I do have a reciept. Now they sold this to another agency to try and collect the balance of the debt. I thought that once its done, its done. What can I do to get this off my report? I have sent proof to the credit bureas but they say that the original debtor didn't accept. Does that mean I have to pay all over again to another agency? My name was never on the original debt, but because he authorized me to use it, they put it on my credit report. Will a letter of intent to sue be good enough or should I hire an atty. Hi Ruth
Did you pay the full amount that your son owed? Was there a settlement agreement? If so then you may produce this. Have you tried to dispute the debt? If you have paid the amount owed, you definitely do not have to pay again no matter whether the OC agrees or not. First dispute the debt with the Credit Bureaus and maybe we can think about suing them gradually. _________________ Keep in touch

| Hi Carol, Yes, I have sent this paid debt settlement paperwork and the copy of the transactions to the credit bureas involved. They have removed it from my sons credit report and have placed it on mine. I was an authorized signer on it for emergency's only and now they claim I owe the debt. The settlement for for the full amt. owed, but by the time they took the money, the comapny had sold it to someone else. This has been ongoing since 2004. Is there anyway to stop this. I really don't think the credit bureaus investigate these, because they refuse to explain. They just keep telling me its valid. Thanks, Ruthie |

Hi ruthie,
It may be valid for them to report the debt on your credit report since your name was on the account. But it's not valid for them to keep trying to collect on a debt that has been paid. And I don't think they can sell it after it has been paid. So if it takes suing them to stop all of this and you can. Then I would. |

| Thanks for the info. I am going to send all this to the atty. general of our state and maybe they can do something so this doesnt keep happening. There should be some kind of government controls on how many times they can collect on a debt or how many times they can sell it. If I manage to get a petition started I will post here if I am allowed so that we can all get these companies regulated better. What do you think? Thanks Ruthie |

I have 3 collection accounts: Wach/Rec, Wachovia Bank of DE and WF/WB R1 all showing the same 5 or 9 digits of account number. All have the same address but show as separate collections. I paid the account as a settlement in 2004 and is reflected on Wach/Rec. with one creditor with a positive close on the account.
Will their be record of settlement on file? I have no documented proof.
How should I go about this matter? Please advise |

| You would definetly need to prove that you settled the debt whether by check or auto draft, but you would need a reciept of some kind. try contacting the one you paid and ask them for a copy of the release. If the won't do it, then send it all to the atty generals office. |

Hi Guest,
Can you tell whether or not you have the payment receipts? If you have, you can use those to dispute the items off your report. To dispute the items, you need to send a dispute letter to the credit bureaus through certified mail, requesting a return receipt. Attach copies of your payment receipts along with the dispute letter.

| Hi, I have two accounts, midland magmt and assett acceptance llc. I have asked for verification 3 times from both of these companies by certified mail. I have the signed receipts saying they got and signed for them. Its been 9 months now and they still refuse to validate these debts. I have also sent disputes to all three credit bureaus by certified mail and I have those recpts too. I asked for validation from all three and it too is nine months ago and all they say is that its valid. They refuse to tell me how they came to that conclusion so I called them.As the lady said, she stated its none of my business how they investigate these. I am now preparing reports about all three agencies to dispute with the Atty. Generals office. I also recently sent them an intention to sue letter. These are not accts from the original creditors and are over seven years old, but they wont remove them from my credit record and still call my son. They call my sons house and tell him my business and he is in the marines and does not appreciate this. Can they legally tell others about my personal business?? I am disabled and I live with my husband, and they call my son and ask him where I'm at and when I am going to pay my bill. I don't owe these people these bills , how do I stop them????? Ruthie |

You can ask for validation of debt only from the colection agencies, not from credit bureaus or the original creditor.
If the collection agencies are not validating the debts, and the credit bureaus aren't verifying the same, you can try the 1-2 punch.
If the above does not work out you can try what you have said -
