Subject: wage garnishment

Posted on Mon Nov 16, 2009 2:20 am

I recently had my wages garnished with no prior notice given to me.
This garnishment resulted from deliquent car payments. I live in Tennessee. Is this legal?

Thanks

I always thought they had to take you to court. But I may be wrong. I'm surprised they didn't try to repo the car. I have known them to do that and turn around and sell it at an action fro almost nothing. And then you are stuck paying the rest. And have no car.

I would go back and look at any papers you signed at the time you took out the loan for the car. Be sure to read through all the fine print. By any chance you did not sign up for the payments to automatically come out of your account? If so they can take the payments out on a certain date. Do you still have the vehicle? If so I would be glad it was not repoed. That is really bad for your credit score and it takes years for one to fall off. Let us know if we can help you with this issue any further, good luck.
