Can GC Collection Agency garnish my disability checks if ia

GC Agency set up a payment plan to pay back a student loan! They put me on what they called a WD Ford payment plan! Ive been making the payments and on time !! Now they told me they were increasing my amount owed each month and was told that they were a federal Government Agency and they would garnish my disability checks if i dont comply and pay the increased amount !! Can they garnish my disability checks if ive been making the payments that THEY set up in the first place ??

I don't believe that they can garnish your disability, you should contact them and tell them to send you a copy of the law that states that they can garnish disability.

You may also want to contact the social security administration and explain the situation to them also, they will tell you if this company can do this or not, but my thoughts are if you have been making the payments that they initially agreed to then they can not garnish, but call the social security office and see before you take my word on it.

Just from 'personal experience', working with my 'Clients'....Disabilty or SS checks cannot be garnished.

Disabilty or SS checks cannot be garnished.

Under certain specific circumstances, the court may produce an order so that your disability benefits get garnished. Under circumstances that you owe certain federal govt. taxes, support to a child, alimony or some student loans, such order might come into effect. Your disability benefits could be protected under SS, only till such benefits remain unpaid and are available to SS.

Once funds (from other sources than SS) get attached to your bank account by a creditor, it's available to the creditor. The best solution to this could be segregating your SS funds into a different account than where you keep your income from the other sources. Please seek the help of an attorney towards dealing with your creditors in such matters.

first of all payments plans should be able to be payment plans gc expects you to pay off 3000 in one lump sum i was laid off lost my house and now no lic, this is ridiculous this agency should be put out of bussiness for the lack of concern for the real world and thier situations, bad bussiness co. and very rude and inconsiderate employees!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
