Received Summons- Can I still send a settlement offer letter

I received summons from the Winn Law Group (First Finnancial Management..)...The complaint was filed on December 10, 2009. But I received the summons two days ago. I have 30 days to respond. Do I count the days from the date stamped on the summons or the date that I received from the messenger.

I want to settle this debt outside of the court. CAn I still send a debt settlement letter? IS it too late? I want to send them a letter by DHL...It took them forever to respond to my DV letter.

I am worried because I want to settle this debt for a lower sum. Maybe 40~50%. I am just worried that by sending a settlement letter, it can be brought against me in the court. I can't afford to pay right now but my family is willing to lend me some money to pay it off...

How do I asnwer a response to the court? Can i get the form online? Do I have to go to the court to get the form? Should I write on the answer form that I have sent a settlement letter?

Make sure you respond to the summons regardless of what you decide to do.

You can still try to work something out with them, but responding to the summons will cover you in case they decide not to work it out with you.

They will not want to be in court either, it is costly for them. I am sure that they will work it out with you before it goes to court.
