credit card judgements

I'm a co-applicant on my moms credit card. I was laid-off in early 2008 from my employer and can't make the monthly payments. The charges were made by me, the card balance is now at $28,000. The recovery dept. has offered a payoff amount of $15,000' (which I don't have at this time). They are now going to take legal actions against my mother who is the primary account holder, and accuse me of financial elderly abuse.

She is 82, retired and collecting social security and a small pension that is direct deposited into her checking account. Can the state of California garnish her checking account? Also, what measures will used on myself regarding financial elderly abuse?

Yes, in California abusing an elder is a crime. It might get you in prison for up to 4 years and force fines worth $1000. I believe, they also have the financial abuse special team (FAST) who're constantly working on such abuse reports.
