Subject: SSDI / GARNISHMENT

I realize I'm to pay child support but now that my income has drastically changed CSE has garnished my SSDI check even thouh I've been paying Child support through workmans compensation until i was cut off two months.

I got my first SSDI Check and they Farnished it without any talks of my wages being lowered.

I am still paying as I was still employed receiving 40.000 a year. I don't have aenough money to pay for a lawyer to file a motion to modify in Texas. However my ex-wife moved to Wisconsin and thats who filed the Garnishment. The original case is Texas. How and where do I file in texas or Wisconsin for modification.

Your wage can get garnished even if you have not received proper information if the debt is valid. Regarding your SSDI benefits being garnished, it can very well be if you have to pay for child support.

What motion do you want to file for? That is not clear to me.

Me or my x neither one of us have a lawyer when we go to court for child support the judge is the one that sets the amount that has to be paid. I don't know how much it costs to go to court to try and have it modified maybe just court costs. I would contact the court they can tell you.
