Subject: Afraid of judgement

The SOL for Florida is 4 years, and i'm pretty sure i'm still in that timeframe therefore if I send PFD letters, and the OC denies those terms, will or do they generally come back with a judgement knowing that I can pay a good amount?

I'm afraid that they are going to deny my offer but turn around and sue me and i'm going to end up in a worse situation than before.

i do understand that they may sue you, but you need to face the judgement.so my understanding about this is better you send those PFD letters once this term is over. Arrow

If these past due bill are still with the Original creditor now would be the best time to resovle them and have them completely removed. If they are in the hands of debt collectors the OC will not get removed from your report with a PFD. One more thing yuou should remmeber is if this debt is prtected by the SOL and you make a payment this again starts the SOL clock ticking.

If you send a PFD letter to the creditor now, there is a possibility that the creditor can sue you to the court to recover the debt if you cannot come to a repayment agreement as per their terms. So I think that you should wait for the creditor to respond first. If they ask you for the debt, you can negotiate for a pay for deletion agreement and then pay off the debt through a repayment plan.

i agree with carol on this issue as the ball is on their court now so you should wait for their response then it will turn to a good strategy in coming years.
