I have a judgment against me from 2 years ago. They just placed a HOLD on my deposit w my bank. How long do I have before the creditor can take from that money or account? What is my time frame?

You should contact whom ever has the judgement against you. You want to do this quickly because once it is a judgement they can garnish wages and lock all assets. You need to see if the judgement is final, because if not you have a right to see what there sueing you for, and they need to show proof. With that being said if you owe the debt then there going to keep your acct on lock until it is paid.

any possible way of stopping your direct deposits that way you can have money to live on while you get this straightened out.

I would do as shaquil says, contact them and see if there is some type of payment plan that can work for you and them. I am sure they will work with you.

I am not saying to stop your direct deposit in an attempt not to pay them, but you have to have money to live on, go to work, feed your family and etc. I would definately look into payroll and see how quick you can make this happen.

Hope this was helpful, keep us updated and feel free to ask other questions if you need to.

Usaually if you have a paycheck direct deposited it can take up to two weeks to get the direct deposit to stop. I wanted to switch my paycheck from going in direct deposit at one time due to hourly mistakes on my pay and it took alomost two pay periods before it could be stopped. This meaning your next check may go in direct deposit but the one after will not. This is why you should go sign any forms necessary to stop direct deposit. I also would call and make payment arrangements. This way a monthly amount can be set in stone and they can only take the amount agreed to.

Hi Joebass
There is a separate Statute of Limitation period for judgments within which the creditor can start the process of garnishment. This SOL may vary from 5 years to 20 years depending upon the state where the judgment was passed. The creditor has brought judgment to garnish your bank account and so your account has been placed on hold. Now if any money gets credited in your bank account, it will be automatically debited and this process will continue so long as the judgment money is repaid in full.

As judgement is against you you have to talk with them and find out the solution.

Discuss the issue with them and do the things with legal background.

Take care

If you have a 'hold' on your account, you need to ask your bank. They would have he information on who is putting the hold on it, etc. I say this because documentation had to be sent toyour bank for them to put a 'hold' on your account. I would talk to the manager and see what's going on.

I recently added my name to my husbands checking account (we were just married in July) and the account now has a hold on it. My fear is that whoever placed that hold on that account will be putting a hold on my personal checking account as well now since my name was listed on there also. Can they do that??

can a creditor take money from account

I don't think you can open another bank account if a creditor is has your 'old' account on hold. Who is the creditor and, can you explain what the hold is for? A creditor can take money out of bank accounts if that was what 'arrangments' were between you and the creditor.

i've had a hold on my account for months now, and the creditor has not yet taken the funds that were in the account when the hold was put in place, nor have they removed the hold. how long can they have the hold in place? i'm paying the creditor monthly...it's just not as much as they want to be paid on that schedule. can they just have the hold on indefinitely? is the hold even legal (in WA) if i'm making payments (even small ones)?

I have a legal hold on my bank account for a judgement from my previous landlord. I was told by the bank that they can only take whats in your bank account at that time and that they cannot keep the hold on your bank account. Meaning that if you only have a $1.00 in your account at the time of the order then thats all they will get. They will have to place another order.
