Subject: 2 late payments resulting in a charge-off

Hi,
I received a written reply regarding my letter of dispute for a charge-off entry on my credit report.
Creditor states payments were 3 months past due which resulted in the loan being charged off.
Executive Analyst in writing acknowledges orginal payment due date was 1st of each month. In Jan 2008 payment due date was effectively changed to 15th of each month.
Also, letter states after thorough review payents for June, July & August 2011 were late. Account charged-off remains and will not be removed.
On September 7, 2011 creditor closed my account stating payments were past due and forwarded to collection for further collection efforts (collection agency same as creditor).
I have supporting documentation monthly payments made Feb thru June 2011 were paid by the 15th each month via auto draft.
July - paid on Sept. 10, 2011(57 days late)
Aug - paid on Sept. 19, 2011 (26 days late)
Sept 2011 through Jan 2012 - currently making on time monthly payments for remainder of $3,800.00 balance.
My question...
If supporting payment documentation validate dispute according to acknowledment of creditor letter -
Is disputing creditor for account charged-off status on Sept 7, 2011 valid and reversable?

| I have a charge-off on my credit report on auto loan I purchased on 10/2004. The date major delinquency first reported was 9/2005 and my charge amount is $6,577.00. I got a head on collision with another driver and my vehicle was total according to my insurance (progressive). My insurance send me a power of attorney to transfer motor vehicle for me to sign because they said my creditor has the original title and that's the only way they can issue a payment to them. The lien has $6,672.33 and progressive will pay off $5,654.47. I want to know if I have to pay the remaining balance? Would my insurance go after me for the payments? Do I need to sign this power of attorney? I tried to contact the collection agency that came after me to try to pay these loan a few years back and they have no record of my name, social security number, or date of birth. What should I do? |

| I have a vehicle that was charged-off. It was included in a Ch. 7 bankruptcy, but I am making payments & current so that the vehicle doesn't get repossessed. Can it still reflect as a charge-off if I'm current? |

This is a gut wrenching situation. My car payments were automatically taken out of my bank account. In July 2009, the last payment was taken out. Or so I thought. In the two and a half years since, I've never considered that I never got the title. Apparently, I was supposed to mail the last payment in, since the amount was different than my normal payments.
The car no longer runs and I want to get rid of it. Because of interest, the $200 or so that I owed, is now like $1200, and is listed as a charge off on my credit! I'd rather not pay $1200 just to get a title, so I can sell the car to a salvage yard for like $150. Is there anyway to be able to get rid of the car? |

| I got behind on my car payments, caught myself back up, and then paid it completely off. The problem is when I went to pull my CR the next year, it said it was a Charge-Off. I called the finance company and they had said it was charged off on Oct 1, 2007. I asked them why this happened and that I had caught myself back up and paid the car off in full plus the late payments. I was never informed in anyway shape or form that it was a charge off. The payment history is as follows: I was late and then I made my first catchup half payment on Oct 8, 2007 and then the remaining on Nov 1 2007. Then because I was caught up I made the remaining payments every month not thinking anything about it. Paid off Sept 8, 2008. My title and a copy of my payment history from them shows that I paid it off on Sept 8 2008 but when I asked for a letter stating Paid in Full shortly after I discovered this, they sent me a latter stating that I had paid it off on Sept 25, 2008. THis would obviously look so much better on my CR if it showed late but paid in full, paid off instead of a charge off, payment after charge off/collection. They state that it was a charge off slash collection on my CR. Please advice, thanks. |
