Being Sued by Gamache and Myers

Hello, a brief breakdown of my dealings with Gamache and Myers and then if someone feels they can help me I will go into more details. Any help is greatly appreciated.

I received a letter (this was the first correspondence I received from them besides a privacey act notoice) in May that they were going to be filing suit against me. I sent them a validation letter within 5 days of receiving their letter. I was served at the end of May by our sherriff dept for court and they were suing me for $2800 on behalf or Arrow Financial. My original card was with HSBC and the limit was $2000.

I hired an attorney and offered to pay GM $1200 upon their validation of the debt. They came back with $1700 and said they do not have to validate the debt. My attorney filed a motion to dismiss. The next thing I got was about 14 pages of questions that my attorney received from the court for me to fill out. I received Admissions Directed to the Defendant, First Interrogatories, and FIrst Request for Production of Documents to Defendant.

I feel like I am shooting myself in the foot if I fill this paperwork out. I told my attorney this and he said I have to fill out the paperwork to be sent back to the court.

What do I do? SHould I trust this attorney or should I try to find a different one? While I agree that I do owe money to HSBC I have no PROOF or validation that GM legally obtained the debt.

your attorney is correct about needing to complete the interrogatories, but ask him what is up with the dv

He said that the CA stated they do not have to provide dv. I am unsure why but that is what they told him. I feel like when I fill out this paperwork I will admit somehow to owing CA when in fact I do not know that I do.

I asked for debt validation after the first letter I received from the CA and the attorney has asked twice?????

Hi sassy,

You are required to answer to the summon, whatever may be the case. You can deny the charges on the grounds of the debt validation issue. Discuss about this with the attorney.

I was sued by these guys to confirm an arbitration award from NAF. Multiple times I asked for validation of this so called debt from the time that I got a letter about the award & the judge even asked in court. G & M stated that they did NOT have ANY paperwork other than the award. They could NOT validate the debt, could NOT tell how much I supposedly owed. This was on a supposed acct from 98-99 that I had paid off. I was taken to court in 2009. Just found out today, online NOT receiving paperwork, that the judge confirmed the award. I now owe over $7000.00 on something that they flat out admitted in court that they didn't have.
I had trouble finding an atty that would help me but I did file statute of limitations & fraud motions but judge still awarded. I am now trying to see if there is anything that I can do.
Good luck with trying to get that validation. But I can bet that they prob don't have it.

I have been dodging them for quite awhile. They are trying to collect on a zombie debt and if they do catch up with me, I will file bankruptcy. This company is predatory and will not leave people alone.

I too have had issues with G&M.
I am paying back $100 a month for a debt that was $700 balance
but owe G&M $1800 due to interest! Profitable business for them.
They served me by sheriff also.

I have also had issues with G&M. When you call, no one seems to know what they are doing. They served me with papers AFTER I sent back the waiver of service paperwork. They are also probably some of the rudest people I've ever dealt with. I ended up sending in a payment to pay them off and they told me it'd be 30 days before they consider the debt paid in full to make sure my payment cleared -- even though it has already cleared my bank. When I asked if anything else would be served since the waiver of service agreement didn't work they hung up on me!!

Hi, I have a debt of $3000.
I have had 2 brain anurysms, and only have an income of less than $800.
I can pay $100. a month on my debt, I own up to this bill.
I cannot make larger payments.
I was instructed by a court letter, to make payments to the court.
I did that, also there is a garnishment on my bank acct., which I can not
write checks or use my debit card.
The court sent my money back to me, and said it should be sent to
Gamache and Meyers attorney.
What can I do?
