Subject: GEMBPPBYCR IS AT IT AGAIN!!!

Posted on Fri Jul 18, 2008 11:53 pm

GEMBPPBYCR is trying to claim another victim. I checked my credit report a few days ago and found a negative charge under them. I have already disputed through the credit report. Today I decide that I would call them and enquire about this account since I had no idea that it was open. Supposedly I opened the account back in 2005 for a credit card through paypal (Ebay). The person said I used the card to purchase something and never payed the balance. He was not able to tell me anything else other than the account is closed and the balance is $160. When he asked how I was going to pay I said I was not going to and that it would be disputed because I had no prior knowledge and they have really messed up my credit. The guy got really upset for some reason, more like he took it personal, and said... "Well, I'll mark on the system that you have refused to pay and now I have to move on" I replied " I am not refusing to pay but merely want to know exactly what went wrong. Then he got more upset because I enquired and said " Ok, you rfused to pay. Goodbye". And hung up on me! I made the mistake of not taking his name and company ID number. What should be my course of action? Thanks!

If you did not open the account then you can file the dispute, but also send a complaint to your attorney generals office and there states also.

Hi lostrikan24
Since you are not sure whether you owe the debt or not, it is always better that you send a debt validation letter to GEMBPPBYCR. If they can validate your debt, and if you agree with the validation try to pay back the amount under a PFD agreement. However, if they do not validate within 30 days of receipt of your letter or if they validate and you do not agree with their validation, dispute the listing with the credit bureaus. But make all communication with the CA under certified mail to keep a proof of the communication.

Thanks for the comments. I have drafted a PFD for them. Does $50 sound reasonable if I don't agree with what they are saying? It was $160.

I will send them a validation letter first and see what they say. Thanks for that idea Anthony.

Goodnatured, they said I opened the credit card and purchased when I was in Florida. I am now in California. Should I write to the AG in Florida or here? GEMBPPBYCR has an adress in Texas so I should write the AG there?

Anytime I have a bill collector call me, I get there attorney general and mine involved right away. If I were you I would use the one in the state that you live in now and the one in Texas where they are.

I had a really agressive collector start calling me, threatening me with suing me and all that crap. I read up on them on the debt forum, so I knew that they were not going to stop short of calling my employer, so I sent debt validation to them, and to both of our attorney generals office. Just got a response stating that they are no longer handling the debt, funny, they threaten me with everything they could until I got the attorney general involved and then they suddenly let the debt go. I thought this was quite amusing, I hate it when they talk all the crap to me and start yelling. This way stopped them dead in their tracks.

Wow these two stories are crazy. I know I wouldn't be sending anyone even $50 until I knew the debt was really mine. Wouldn't that kind of verify the debt...showing you paid on it. Your collector sounds like a real jerk good natured. Hopefully they didn't sell it and the bull will start all over. Is it still in SOL?

Fire, thanks for responding. The $50 I would send them to erase that debt is not verifying the debt. The PFD letter clearly states that. It's just a way of coming to terms with them so that it will be erased from my credit report. The PFD says that the $50 dollars is for that reason, and that reason only. I am not accepting this debt when I did not do it. I am sure these companies do this to millions of people a year for a little amount of money. That little bit turns into billions for them.

Either you owe the money, or you don't.

If you don't owe the money, then the only reasonable amount to pay is $0.00.

If you do owe the money, then $50 is IMO, not reasonable at all for a PFD.

Sending them any amount at all is going to be like you owe the debt, they are not going to erase it and forget about it. If you don't owe it then I agree with morningstar, don't pay them anything at all.

I said $50 because they say the amount is $160. Thanks for the advise, I will send them a validation letter first. I will also send one to the AG's. All through certified mail.
