Hello John,

Welcome to the forum.

In my opinion talk to the finance company, try and make the last four payments to get anything going. Only when you have the car in possession the auto title will be signed over by the vendor and you have to take the title to the DMV (Department of Motor vehicles) and get it done in your name.

hope that others will come across and give better opinions.

I presume, when you pay it off. A charge off means you haven't paid in 6+ months...it does not mean that the debt has been forgiven.

If you want the title to your car youl have to negotiate with whoever has the title some kind of settlement.

You can pay it off, but that's about all you can do...your brother screwed you over. If the car was stolen, where is the insurance money...or did your brother
a) not have insurance, or
b) take the money and run?

What a shame that your brother would put you in this situation, hopefully he will help you make the payments, they always say that family will give it to you first. I hope you get this all cleared up soon. Morningstar is right, you are totally responsible for this bill. Did you or your brother have insurance on the car? Did he file a police report? He should have no matter where he is. Goodluck, hope you get this resolved soon.
