i sent a dv letter back in august i never received a response. I
was away for a couple of months and just got back, is it to late to send an intent to sue

Hi jellybean,

Welcome to the forum. You can definitely sue the creditor via
Consumer protection afforded by the FDCPA

FDCPA
Section 809 (b),

The fine is $1000.
