I sent out some pay for delete offers around April 10th or 11th. Some companys have accepted and been paid while a couple never replied. How long should I wait to respond and what should I send? Should I resend a DV letter or the PFD offer too? I dont want to seem desprate.

Hi CMBV22

I think you should first resend a debt validation letter requesting the CA to provide validation of your debt. Once they reply to your request you can put forward the Pay for deletion offer after coming up with an agreement with your CA that you will pay the debt in full or a percentage of it. But make sure you always get it in writing else you would have no legal ground to stand on.

Hi CMBV22
If the CA does not respond to your debt validation request, you can always complain against the CA to the FTC ( http://www.ftc.gov/ ) for violation of the FDCPA and fair credit reporting Act.

Basically, I sent out the first DV letters in March and got little to no responce. The companys that did send some kind of validation sent me really poor information that wasnt worth the paper it was printed on. I then sent out a second DV letter in April with a PFD offer to each company. All of my communication with the CRAs is Via certififed mail. NOw that the PFD offers have been out about 30 days now. I am trying to figure my next steps. I did dispute most of the listsng with the 3 credit bureaus. I guess I could start the method of verification process but, my main goal is to get all of the listsing removed from my credit.... Any advice? :?

Hi CMBV22

You can ask the credit bureaus to give a complete credit report mentioning them the listings which you do not agree with. You can always sue the CRAs in the state or federal court for violations of the FCRA and if you do win, the defendant is liable to pay you for all damages and will reimburse you with the attorney fees as per the court order.

I dont think it would do much good to send the Dv letters to the CB since they are not obligated to vailidate anything until you dispute a listing with them and they verify it. Then you can start method of verification.

As far as my situation goes I am going to draft a method of verification letter and send it to the 3 CBs in the next week. Depending on how that goes I'll send the CA some inent to sue letters.
