Threatening to serve me with papers

I have been contacted by a collection company threatening to serve me with papers for fraud charges for a payday loan that was taken out in February 2012? I don't have the funds available to make the payment this week they are requiring... Can charges such as this be filed?

What is the name of the pdl company? I’m pretty much sure that the loan is illegal. If this is the case, then they can’t take any legal action against you. But if the loan is legal, then they can sue you because of non-payment of debt.

I have been receiving threatening calls from a "Performance Recovery Services" for two weeks on a payday loan from 2010 or 2011. I paid on it for a while but soon had no funds to continue to pay. PRS is calling me threatening me with arrest and court. One lady even began screaming at me over the phone. I even have them on voice mail threatening me. I have asked for a debt validation letter even by email. they wont send one. I have asked for their address, they wont give it to me. the last phone call I had with them was yesterday. I was told I would get written paperwork on the debt when I settled and paid the debt. I filed a complaint with the federal fair act but what do I do now. It has been almost a year since I made a payment on it. I have looked at the texas laws and what these people are doing is illegal but they wont stop calling me. What do I do?

File a complaint with your State Attorney General. It is illegal for them to threaten with any type of criminal actions or charges. Also file a complaint with the Federal Trade Commision
