Warrant in debt is a summon issued by a court for the debt you owe. Whenever a creditor or a collection agency files a suit against you in a court to recover the outstanding debt, you receive a summon for the same. This is known as Warrant in debt. On getting the warrant, you should immediately file a response to the summon else the creditor can bring a default judgment against you.

Yes, if you receive an warrant in debt from a court, you need to file a response within the period as mentioned on the summon. Moreover, you can receive a warrant of debt from administrative authority if you have a Federal Tax debt. Warrant of debt is filed by a plaintiff if he wants a money judgment. While filing, the plaintiff must mention the amount for which he wants to bring the judgment and the reason for bringing the judgment.

Also to add to the post..back arrearages on child support can cause a warrent or court summons. All of the above can be collected by attaching wages, bank accounts or tax returns.

I have a similar situation upcoming. I am planning to go to court and hope they will accept what I can pay monthly as I have no savings, etc. due to being out of work for 15 months and playing catchup with mortgage and other creditors.

I am not sure on that but I would not think so. You should just get a court date and you need to appear. Now remember if you do not appear then they will issue a default judgment against you and you will be responsible for the debt. It is always on your best interest to show up at a hearing because you can plead your case and maybe set up payment arrangements instead of having them take everything in your checking account.

so my fiance and i rented from his aunt for about 3 years...they never fixed anything and for the 1st 2 years we didnt even have a lease signed. Towards the end we had just had our 2nd child and money got super tight and some things went wrong with the water pressure and plumbing so when they wouldnt fix it i didnt pay the rent for nov 09...we were out by the end of the month anyway...now in May we got a warrant in debt...what happens next and do we have a leg to stand on with the whold not having a lease until the last year we rented and with them not fixing anything...will they let us make payments...we dont have the kind of money they are suing for...not even close.

Hi Ashley,

Warrant in debt is like a summons which you need to answer. It is served to the debtor before he/she can be sued, and in some jurisdictions this is the initial filing that starts the garnishment proceeding in some states. Thus, you can check out the state laws on warrant of debt.

Another thing is that you both need to make a copy of your monthly income and expenditure. You may need to show this in court before the judgment can be issued, so that the judgment amount an be settled.

Hi Betsy,

Whether or not a Warrant in Debt will show up on a criminal back ground check depend on various factors. This can depend on the state laws, the financial status of the person, and his work designation. This will also depend on the reason for which the background check is going to happen. If it is for a passport or visa, then the warrant may show up.

I read in the VA Statues that if a debtor no longer lives in the state isueing the Warrant in Debt, he can not be compeled to appear in the original signed contracted debt owed and oter steps must take place. Is this true ? Also what is the Statute of Limitations on Credit Card repayment default in Virginia? Been out of work since June 2009
