Subject: can ca report debt to CRAs without a dunning letter?

I have a CA that called by home on the 3rd of June. The only information that passed between myself an dthe CA was that ll communication was to be via USPS and I would be requesting DV. I then sent a DV letter the next day via cert mail informing them *Zenith Aquisitions* that during our first communication on the 3rd no information was exchanged other than my request that no calls be made to my home/office and that a formal letter requesting DV and to CND phone calls would be mailed the next buisness day.

So, on 6/4/08 I sent a DV letter to them via cert mail. They signed for it on 6/9/08 at 12:13pm. That same day they placed a derogatory listing on my husbands CR. They also called my home on 6/11/08 informing us that if we didnt take immedaite action they would have to pursue more aggressive actions.

I made a complaint with the FTC that they called me at home after my written CND letter was delivered and I intend on disputing the negative listing on my CR as I have not recieved one piece of written correspondence informing me of who the OC is, what the debt amount is....ANYTHING!

Now I want to go to the local court house on Monday and file suit. Do I have a strong enough case?

If the CA calls again, you may have a case. For all you know, the CA could respond by alleging that the call on 6/11/08 was just to inform you that the CND letter was received.

You are required to be sent a letter within 5 days of initial contact (6/3/0Cool. If you do not receive one soon, you may have a case...but I doubt that at the present time, you have much of a case at all.

Yes, a CA can report to CRA without a dunning letter. If you've sent a DV letter, then the CA needs to validate or remove the debt from the CR.

i did send a dv letter. they signed for it the day they dropped this a-bomb on my cr

I made a HUGE stink with the FTC, BBB and CRAs and got the listing removed. I then gave them a couple hundred to go away and guarentee in writing I'd never hear from them again

That really stinks when you pay for delete and they do not follow through. Did it take a lot to get them to comply? Which of the three actually work better, the bbb, FTC or the Cr?

NO the complaint to the BBB really motivatd them. After it was filed all I had to do was make one phone call and I had the PFD agreement mailed to me the next day via priority mail

Good for you, glad that it happen so quickly for you. I was not aware that the BBB worked that aggressively for a consumer, I usually use the attorney general office, but maybe I should give it a shot through the BBB. Thank you for sharing this information, I am sure it will be useful to many.

I was pretty shocked also! I really only put in complaints with them b/c I wanted to have a huge list of complaints to send to them. Out if the 2 companys I sent comaplaints to the BBB about both have respinded and are really owrking to make me happy.

I have gotten reports back from the credit reporting agencies, usually they will say either updated or remains the same. So yeah, you do get some type of result back from them.

They did inform me of the deletion but, that was only b/c I had dispute the info with them. They do not normally inform you of each change unless you have disputed it or, they feel it might be some kind of ID theft

wow I never thought of using the BBB. Wonder if it would work if you have people calling due to getting their phone number. This has been a constant pain for me. Soon as I got this # when I moved it has been a hassle. I have weeded alot out with threats but still a couple still call. I know their co. names could I call?
