Subject: recent Collection account on credit report

received bill for account in October 07. Disputed account but finally had to pay it off in January 2008 to avoid negative mark on credit. Just today i pulled my credit and creditor has reported it on January 2009. How can they tag it to my credit report a year after payment??? Per FDCPA how long does a creditor have to paste negative info on your credit. Crying or Very sad

original creditor remark will remain on the credit report for minimum 7 yrs. thus there is no solution to remove this mark as the case is reported to credit bureau. Arrow

The creditor can list the negative item on your credit report anytime within the seven year period and you cannot get it removed from your report before seven years and six months from the date of your last missed payment towards the debt. This is as per the Fair Credit Reporting Act.

but the account had not charged off???? we moved end of July 07, received a bill from Hein PC (not the aparment complex) in November 2007, tried to resolve the issue to no avail, they sent us final letter saying if we paid no credit impact, so we did in Jan 2008. Now in Jan 2009, they have added it to credit. the info about deliquency is wrong? How can all this be right??? SOmething somewhere is wrong?

You should send a debt validation letter to the creditor whose name appears in your credit report against the debt. As a proper debt validation they should provide you with the details of your outstanding bills. Now, if they cannot validate the debt, you can send a dispute letter to the bureaus along with a copy of the proof that the payment has been made and the bureaus will get it removed from your credit report. Henceforth please keep in mind that whatever any organization/person promises they should give it in written format so that you won't be in trouble later on thus you will have a good stance when it comes to further dispute.

Now in this case you must ask them the debt validation letter and then accordingly proceed further, if they are reluctant to provide the debt validation then you must report this to the credit bureau in written format. Arrow
