Is the CA allowed to do a hard pull without permission

I was called at work today by a CA. They are trying to collect a debt from an old student loan I had defaulted on previously. However, I settled this debt with the CA the holding the account. That was in November 09. I received a Zero balance letter from them. Thus, I mentioned this to the CA who was was very rude. I work in an open cubicle and it was so embarassing.

I pulled my credit report today. There is an inquiry from the CA with today's date. Are they legally allowed to hard pull my credit report without my permission?

As far as I understand, if the hard pull was done without your your permission then you have the right to dispute this. What you can do is ask them to stop calling you at the workplace. Under the FDCPA, the collection agency (CA) is not allowed to harass you over the phone or even threaten you. For that you can sue them.

As for the debt, if you have copy of the payment, you can send the CA a "cease and desist" letter, attaching a copy of your payment to the previous CA. You will get a sample "cease and desist" letter at http://www.creditmagic.org/repair/cease-desist-letter.html .

Can you tell me if the payment was made in full? You can also contact the previous CA and inquire into this.

if they buy the debt, they have a permissible purpose. But in this case the debt is paid. I think to sue, you have to send a C & D letter first.

How can a CA buy a debt that is no longer there? The OP DID say the debt was paid. So...the 'new' CA had no right to pull a credit check.

sdcharger, they will say that they were collecting in error. they could have bought it before it was paid and/or were sold it fraudulently. bad credit pulls are hard to prove

"Bad credit pulls" really affects us. If 'we' have alot of credit pulls (legal or illegal), it seems like they will NEVER come off. Every 'hard inquiry' makes your credit score go down.
