Incorrect amount being reported

I received a collection letter and the amount listed was incorrect. I immediately sent a Cease & Desist letter. They received the letter and I have the return receipt showing the receipt. This was in January 2010. I now see that they have placed a collection item on my credit report.

What are my next steps. Can they legally report this to the CRA after a Cease & Desist letter? The amount they have reported to the CRA is incorrect as it does not include payments made to the original creditor before it was placed for collection.

Ultimately I want it removed from my report. it is the only collection listed on my report. I would appreciate any recommendations on my next steps to have this removed.

Hi Moore,

A cease and desist letter is sent only when a collection agency is harassing you inspite of the fact that you don't owe them any dues. In this case you should have sent them a debt validation letter.

Debt validation letter is sent when you are unsure of the debt. However, if you are sure that you owe this debt, but the amount reported is incorrect, you can dispute this. If you have proof of the amount that you owe, you can attach a copy of that along with the dispute letter.

Thanks,

Aaron

the Debt Validation letter is a dispute of the debt and they are required to respond to the dv before they continue any collection activity.

after the C&D they are actually supposed to sue you, if they want to pursue collection. I am not sure whether they can keep reporting it.
