Early this year I opened a new credit card with Chase Bank, made a purchase with it, got sick, failed to make payments. Because the account was new, no one taking care of my affairs while I was sick was aware of it and didn't take care of paying it. The bank closed the account and referred it to collection. Subsequently I paid the balance to the collection agency. I contacted Chase, explained the situation, offered to reimburse them for the collection agency charges and asked them to delete the write-off from my credit report. They refused and said that their policy is that the item will continue to appear on my credit report for 7 to 9 years. Is there anything I can do?

Really there is not much you can do but file a dispute if you feel that the information is not correct, you have to file a dispute with each of the credit reporting agencies.

You have to go each one of them and do it separately, if you need help, please let us know.

Someone else had the 'ad', on this forum, about Attractive Secrets (dot) com. Don 't you have to pay to get this information?..from what I understand, anyway.

The original creditor can remove a negative listing from your credit report only if he has transferred the right to collect the debt to the collection agency and has not sold off the debt to the CA. If it has been sold off to the collection agency, both the collection agency and the OC listing will stay in your credit report. Now if you make a pay for deletion agreement with the CA, then the CA listing will be removed but the OC listing will stay there for seven years.

I agree with Anthony. But to remove the name of the collection agency from your credit report, you should have come to a pay for deletion agreement with the creditor before you pay off the debt in full. Now since you have already made the payment, I don't think that the collection agency will remove it from your report. However, you can try once by calling up the CA and requesting them to remove it from your report.

So, if you can make a 'deal' with the OC, you can get the debt removed? If the debt IS removed, then does the CA automatically ome off, your CR, too?

Once again... I must respectfully disagree with the posts here...

PAYING A DEBT (OR ALLEGED DEBT) WITH ANY CREDITOR, ORIGINAL OR THIRD PARTY, DOES NOT CONSTITUTE A REASON FOR DELETION OF THAT ACCOUNT. IT MUST SIMPLY BE NOTATED AS PAID OR TRANSFERRED TO ANOTHER LENDER/CREDITOR.

If a company offers a delete for pay, that's fine, and if it fits into the budget, go ahead... But understand that they are not only NOT REQUIRED to do so, they are SPECIFICALLY asked NOT to do so by the bureaus, and the organization that writes the manual for data furnishers...

Transferring the debt or selling it to a third party DOES mean that the original company may no longer show a balance due, or a past due balance. That is an illegal duplication of information, subject to FCRA, FDCPA, and DTPA statutes.

Doc is right in the sense that paying off a debt does not necessarily mean that the creditor or the collection agency would agree to remove the negative listing from your credit report. But if you make the entire payment of the outstanding debt, the creditor has to list the debt as "paid" in your report. It is upto the creditor or the collection agency to agree to your offer to pay for delete. But if you can somehow make the creditor agree to pay for delete, get it in writing.

CAROL........ok........I catcha now!! I thought if you had a PAID debt, you could dispute the CB's. So..you're saying it's not the decision of the CB's to remove it, it's the decision of the OC or CA. Well......sometimes CA's can be hell to work with.

It is true that the Federal law does not necessitate deletion of the negative listing from your report as soon as you pay off the debt in full, you should always try to negotiate with the creditor for PFD before you pay off the debt. If the debt is not sold off to the collection agency, then you should come to a agreement with the original creditor for pay for deletion. To know whether your debt has been sold off to the CA or not, all that you need to do is to send a debt validation letter to the collection agency whose name appear in your credit report.

Yes Chargers, the credit bureaus delete the negative listing from your credit report only if the creditors or the collection agency ask them to do so. Therefore, if the creditor agree to the pay for deletion agreement, you should always get it in writing so that if the creditor does not remove the listing from your report after you pay off the debt in full, you can send a copy of the letter to the credit bureaus and ask them to delete the listing.

Repairing my credit. Need advice on how to remove old items and inquiries off the report. And is there a way to remove old mortgage companies that were paid off and have negative lates reported.

So the thing to do is to call the credit card company and tell them, " Look, I owe several people money and am only able to pay one, that is going to be the one who works best with me. I can give you $1500 of the $10,000 to settle the debt if you show it as paid and not charged off or settled and remove any and all negative reports in the past and resulting from this deal. Would that work some of the time, a majority of the time, or not at all?

I know I've asked this question before, but..I don't think I received a response. If you send a DV letter to a CA, and they DO NOT 'validate' the debt, can you send a copy to the CB's and ask for the debt to be 'removed' under THIS certain circumstance?
