Need help removing an item from my credit report

Early this year I opened a new credit card with Chase Bank, made a purchase with it, got sick, failed to make payments. Because the account was new, no one taking care of my affairs while I was sick was aware of it and didn't take care of paying it. The bank closed the account and referred it to collection. Subsequently I paid the balance to the collection agency. I contacted Chase, explained the situation, offered to reimburse them for the collection agency charges and asked them to delete the write-off from my credit report. They refused and said that their policy is that the item will continue to appear on my credit report for 7 to 9 years. Is there anything I can do?

Really there is not much you can do but file a dispute if you feel that the information is not correct, you have to file a dispute with each of the credit reporting agencies.

You have to go each one of them and do it separately, if you need help, please let us know.

The original creditor can remove a negative listing from your credit report only if he has transferred the right to collect the debt to the collection agency and has not sold off the debt to the CA. If it has been sold off to the collection agency, both the collection agency and the OC listing will stay in your credit report. Now if you make a pay for deletion agreement with the CA, then the CA listing will be removed but the OC listing will stay there for seven years.

I agree with Anthony. But to remove the name of the collection agency from your credit report, you should have come to a pay for deletion agreement with the creditor before you pay off the debt in full. Now since you have already made the payment, I don't think that the collection agency will remove it from your report. However, you can try once by calling up the CA and requesting them to remove it from your report.

So, if you can make a 'deal' with the OC, you can get the debt removed? If the debt IS removed, then does the CA automatically ome off, your CR, too?

Once again... I must respectfully disagree with the posts here...

PAYING A DEBT (OR ALLEGED DEBT) WITH ANY CREDITOR, ORIGINAL OR THIRD PARTY, DOES NOT CONSTITUTE A REASON FOR DELETION OF THAT ACCOUNT. IT MUST SIMPLY BE NOTATED AS PAID OR TRANSFERRED TO ANOTHER LENDER/CREDITOR.

If a company offers a delete for pay, that's fine, and if it fits into the budget, go ahead... But understand that they are not only NOT REQUIRED to do so, they are SPECIFICALLY asked NOT to do so by the bureaus, and the organization that writes the manual for data furnishers...

Transferring the debt or selling it to a third party DOES mean that the original company may no longer show a balance due, or a past due balance. That is an illegal duplication of information, subject to FCRA, FDCPA, and DTPA statutes.

Doc is right in the sense that paying off a debt does not necessarily mean that the creditor or the collection agency would agree to remove the negative listing from your credit report. But if you make the entire payment of the outstanding debt, the creditor has to list the debt as "paid" in your report. It is upto the creditor or the collection agency to agree to your offer to pay for delete. But if you can somehow make the creditor agree to pay for delete, get it in writing.

CAROL........ok........I catcha now!! I thought if you had a PAID debt, you could dispute the CB's. So..you're saying it's not the decision of the CB's to remove it, it's the decision of the OC or CA. Well......sometimes CA's can be hell to work with.

It is true that the Federal law does not necessitate deletion of the negative listing from your report as soon as you pay off the debt in full, you should always try to negotiate with the creditor for PFD before you pay off the debt. If the debt is not sold off to the collection agency, then you should come to a agreement with the original creditor for pay for deletion. To know whether your debt has been sold off to the CA or not, all that you need to do is to send a debt validation letter to the collection agency whose name appear in your credit report.

Yes Chargers, the credit bureaus delete the negative listing from your credit report only if the creditors or the collection agency ask them to do so. Therefore, if the creditor agree to the pay for deletion agreement, you should always get it in writing so that if the creditor does not remove the listing from your report after you pay off the debt in full, you can send a copy of the letter to the credit bureaus and ask them to delete the listing.

So the thing to do is to call the credit card company and tell them, " Look, I owe several people money and am only able to pay one, that is going to be the one who works best with me. I can give you $1500 of the $10,000 to settle the debt if you show it as paid and not charged off or settled and remove any and all negative reports in the past and resulting from this deal. Would that work some of the time, a majority of the time, or not at all?

I know I've asked this question before, but..I don't think I received a response. If you send a DV letter to a CA, and they DO NOT 'validate' the debt, can you send a copy to the CB's and ask for the debt to be 'removed' under THIS certain circumstance?

Donald, Usually debt settlement is about 50-70% of the amount owed. They may settle for as low as five thousand but I am not too sure on the $1500. If the debt was really old and well past the statute of limitations you may be able to pay it off for that. One other reason they may accept a smaller amount is if they do not have the original contract and could not validate the debt. The only thing is I would not suggest paying a debt that was not validated.
As for removing it from your report entirely...if it is the original creditor they could but if it is already bought up by a debt collector then the only listing that would be removed would be theirs and not the original creditors.

Never REALLY thought of that, FIREYONE. I mean, I DO get letters, from CA's, on debts that are a few years old. Asking for a fraction of the amount that is ORIGINALLY owed. But..I see your point when you say you should never attempt to pay on a debt if it can't be Validated by the CA.

No credit card company or collection agency will agree to settle for 15% of the outstanding debt amount. If you want to go for debt settlement, the credit card company may be willing to settle for 60% to 80% of the outstanding debt. This means that if you have a debt of 10000, you may need to pay 6000 to 8000, in order to avoid charge off. However, after pay off the debt, the status will only show as "paid" and will stay in your credit report for seven years.

Couple of things......

1) Never pay a debt that is with a third party.

2) Never pay one that isn't validated. You have no contract with them, and they can seldom even prove that they are entitled in a court of law.

3) Settling a debt for less than the amount owed will reflect that way on your report, and that statement on your report is more damaging than "Paid In Full". Better having it closed, regardless, but I thought you should know the difference...

Whom is considered the third party in debt collections. I am thinking the first party is the original creditor, second the first collection agency is third any collection agency after that or is it the first party the debtor..second..the credit card company..then the third being the debt collection company? I keep seeing where you respond and just trying to figure out for sure what the correct order is.

Can a status of a credit card show...paid as agreed and "written off"?
I have been trying to clean up my report for a couple of year now. I had 12 and now only have 3....although one of the 12 was paid off....Chase shows up as a new account using an account that was paid off. I duisputed it and was told by experien that it is a legit account. I have proff that it is paid but yet they will do nothing about it.

I have recently applied for a home shopping catologue and was refused due to adverse credit that was on my file. Due to this i have requested my credit file from both experian and equifax to see what this default was connected with. When i viewed my reports i found that the default was connected to the same creditor. However this agreement was taken out by an ex-partner in my name and without my knowledge. The account was settled in 2006 but still remains on my file- apparently for another 3 years. What would be the best way to address this problem and is there any way of getting it removed from my report. Any advise would be appreciated

Hello,
Currently my husband and I owe approximately $80,000 in debt. My husband works part time and I work full time. We have been paying most of the credit cards on time except Citibank and Chase. One of the accounts was referred to a third party agency. The original balance is $9200 and are negotiating to $4200. Not sure what to do because we either are thinking of letting go all the debts meaning don't pay them until they settle with us or just file BK. Reality is we owe alot and I am also trying to save a for a fertility treatment which in California we pay the entire amount another $15,000. I am feeling stressed and trying to figure out what is best. Alliance is the thrid party collection agency. Not sure which looks worse on credit. Thannk

my husband and I spilt up anf he said that he would make the payments but was late making them .I didnt know anything about him being late , plus I find out that I am not on the deed or taxes .i called them they said i was not the primary on the loan and they only had his numbers .Can I hire somebody to get this off my credit .

Who's traveled to the states

I have only been to the states twice: Once on a 2 week trip in NYC and va (together with DC), And another flying stop by at NYC.

New York totally lived up to the hype to me i have been previously to other major world cities (Hong Kong, Dubai, Istanbul) And lived both in London and Paris, New York really felt like the centre of the whole world. This flabbergasted me somewhat, As you read so much nowadays about how it's lost its edge thanks to restrictive immigration policies, And how London is now more open and modern but I didn't feel this at all. London and Paris felt slightly parochial likened. You get the impression that almost nothing fazes New Yorkers.

I was surprised at the squalor of the public facilities (Subways, lines, Public pieces) as opposed to opulence of the private (locations, cafes, bars) As I'd always had the impression that NY was a bit more lefty than the rest of the US. Paris is the exact opposite public toilets are often nicer than those in restaurants! The tube/mtro are SO much cleaner and more efficient the only source of accumulated on the subway seemed to be tramps and hobos! However I was dumbfounded at the extensive gentrification in Manhattan even Harlem felt vibrant and lively, If not productive though I never ventured to the Bronx or Queens. Buildings can be a lot more dilapidated in poorer areas of Paris/London. The natural setting of NYC on the harbour and all those islands is magnificent, And something that doesn't get talked about enough. It beats landlocked London and Paris absolutely. I visited in summer both times and contrary to what I'd been lead to believe found the climate pleasant and warm getting too hot and muggy.

DC was quieter and leafier than I was ready for. not really a world city. I was surprised at what amount intact Victorian architecture there is in both DC and NYC your impression in Europe from the movies is that everything in the US is brand new, Which will never be true.

The rest of the state Virginia did live up to my image of the US vast distances, line malls, Big cars, Big workers, Fast food pretty much everywhere! Another thing that pretty spanish girls struck me was that every thing has a slightly 1990s feel the malls, The fonts used on public signage what surprised me; summer time climate and the scenery are gorgeous : Constant mediterranean and beyond sunshine but with lush green almost English scenery. With smaller roads and more thoughtful success (Less aggressive sprawl) It would be a paradise it seems a shame to spoil that countryside with pointless freeways and parking lots normal basis, This could not be allowed in the UK where we are much more careful with our space.

Generally though I was surprised at how unspoilt many of it is, Particularly in high altitude you can see for miles across virgin forest: In the world, It is a lot more densely populated so similar vistas are always peppered with villages and roads and farms.

The food in New York and DC I found to be amazing (Which i expected) But Virginia sadly was dreadful all fast food and even when you found the odd independent guesthouse and caf the portions were obscene and tasted like cardboard.

Obviously mentioned are random musings, And totally summary. I'm sure someone will be restored saying that New York was actually a big let down and that you can eat really well in Virginia!

Would become to hear what Americans' thoughts were on first visiting the UK/Europe?

I actually had very similar impressions to you. I too felt much of the US felt surprisingly little retro, The 'slight 1990s feel' you chat about. LA in truth felt very '20th century' to me, Even say setting sun Blvd, Just the design of the buildings, the store fronts, A lot of the structure. Coming from Australia I thought California would look extremely modern but in some ways it genuinely seemed a bit dated, In a in order to good way.

I was a huge fan of NYC before I traveled to and agree, It still can evoke the no. 1 city across the country despite London, tokyo, japan, Shanghai trashing on it's doorstep. Tokyo might have the best way to, London might challenge it as the worldwide 'financial centre' or have people who speak more languages, But that counts for nothing when you actually visit the big apple: It's a frame of mind, It is THE penultimate 'big city' anywhere and the rest are just imitators. The first skyscraper all over the world, The Flatiron improving, is set in NY, And don't you others forget that lol.

Yes the subways are grungy, And NYC suffers from gritty: But do you know what, I individuals. NY has a popular quality about it: I feel it'll always have that strong 'New York' feel that transplants cannot remove or time will not change. Harlem felt like a timewarp into 1970s, There wasn't as much gentrification as i was thinking.

DC also pleasantly impressed me. the deficiency of hole in the wall diners and prevalence of fast food was a bit depressing, Also Holiday Inns on the inter state was kind of weird.

Americans themselves seem quite dissimilar to Australians. a few staff in restaurants and diners down south were really nice though. I do get the opinion that it can be a hostile place, most of the people behaving like jerks. I was scolded by the immigration official for not being aware of how to use a complex device i'd never used before, And called names by a small grouping of firefighters lol.

By the time I actually went to Europe I was as well versed on what I would see there as probably 90% of people that had already been there, So not much came as a an unexpected. rather:

1. The people were continues to well dressed. They did not dress in a notably exotic style, But much as American upper middle-class "Yuppies" (Or white color Manhattanites) decorate.

2. how little ethnic restaurants across Spain. Even in the capital city's the yellow pages, Listings for restaurants serving food from the various regions of Spain vastly outnumbered restaurants serving foreign cuisines. Despite the large ethnic communities found in some places throughout Spain (Ecuadorians, Pakistanis, etc.), Few eating places serving those types of cuisine could be found. american indian, Ethiopian, japanese, chinese language program, british, and.

3. The role enjoyed by "bares" In learning to speak spanish culture. Are generally places devoted to the intake of alcohol; basically bar food is a second thought (Although progressively more bars are known for their food) And lots of weird NOT ordering alcohol. Children or teenagers are rarely seen in them, And might even be forbidden from entering them by local laws. in spain, Bars are more places of social, And have excellent desserts from my experience (Bocadillos special). gourmet coffee, in the daytime.

4. The apparent uniformity of some issues with the culture. foods are one, Bares are another, as well as. Spanish people seem pleased with less diversity and more "Normalcy" Than residents, Or you have got less of an "alternative" or "clever" Sector in the Spanish number of people.
