Date of last payment or date of first delinquency

I have been reading the boards and was under the impression that the date of last payment is the one from where we would start calculating SOL but now I think it is is DOFD. Can someone explain and advise.

I sent a SOL letter to a JDB because I thought the debt was past the SOL...they have now answered that letter with "validation". In looking at my CR the DOFD is 4/2004 and the Date of Last Payment is 3/2004 - which date determines SOL?

Thanks.

Hi Adonis,

The Statute of Limitations starts from the date of first delinquency, and it depends on the state you live in, and the type of account. Thus, you can check the statute of limitations of your state.

As the date of first delinquency is on 4/2004, the statute will be counted from this date. Can you tell the name of the state you live in?

Thanks,

Aaron

It wasn't delinquent in 3/04. it was 4/04 when the bill became overdue.

What state do you live in?

who is the original creditor?
Is the negative tradeline a Collection Agency or the Original Creditor?
