Wells FarGo not reporting six years of stellar payment (mort

Kind of a different situation here, or at least i think so. My exwife and i divorced over 8 years ago. She filed bankruptcy on the home mortgage , and i stayed in the house never refinanced it. I got back on my feet in about a year and a half , and started making my payments perfectly now for over six years. Have not really tried to reestablish credit because the thought of being denied , killed me . I just assumed it was fixing itself and one day it would be all better. Went to buy a car with present wife and credit union loan officer called asking what was up with my mortgage. The way it looks on paper is , i have not made some payments over the years , have made quite a few over sixty ,several over 90 and several over 30 . I just started digging harder and examining and can see that the last reporting was done in 04. But again it doesnt just jump out at you on the credit reports so no wonder she called. I called Wells Fargo asking for help in correcting , was given the run around by more than one cust serv rep , and then about a week later , I get a letter in the mail saying upon investigating my inquiry ,b/c of someone in the household filed the bankruptcy credit reporting was ceased and desist. And would not report for the life of the loan...... Wow is this really fair? legal?? This sux, I paid my dues , did not file bankruptcy , got on a repayment plan with them just to keep my home and meet my obligations just to get slapped in the face with this??? I have not been 1 day late in six years , and have not gotten one bit of credit for this biggest spot on anyone's report....... since they will no longer report , can I just walk away free and clear also ??? my new wife has begged me to get out of there anyway ..... I have half a notion to do so..... someone please tell me what to do if anything....

Funny ..... the bottom of the page says somthing like were in this together..... or together we'll go far..... yeah whatever....

Hi dookie,

Welcome to this community :)

Can I know if the mortgage is both in your and your ex wife's name? Under which chapter did she file bankruptcy?

Thanks,

Aaron

Sorry for the delay . Arron thank you for responding . My ex is still on my mortgage , when we split i was left with everything , house , 2 year old little boy that i had to (wanted) care of , a truck payment and several bills that I had a terrible time paying. credit Went to crap right away.I could not refinance into my name at all.
She filed chapter 7, I probaly should have if i knew i was going to get a slap in the face by my mortgage co.....
I really wonder how can they say they will not report for the life of the loan?? especially when i have met my obligations for six years with them.. . Can i legally walk away? and not have any further reporting...because I would sure like to . I am not receiving anything for my doing right. And have no attachment to this place whatsoever. Money (equity) doesnt even make it better.

It sounds like the mortgage was in your wife's name and you were not, is this correct? It makes a huge difference on whether they will report, if you can walk away etc...

no it was in both of our names . SHe filed chapter 7 , I did not . I stayed in the home. perfect payment history for me for over six years. I called to complain , could not get them to call me back. I got a letter in the mail stating they would not make adjustments on the reporting , nor would that do any further reporting for the life of the loan.

Sorry for the late reply. However, I think the debt was not reaffirmed. Thus, the problem regarding the reporting. I am afraid there's nothing you can do now.

Thanks,

Aaron

Hi dookie,

HOW IS THIS LEGAL ?

Yes, I am afraid this is legal. Unless you reaffirm the debt after bankruptcy, the payment history won't get added on to your credit report. If you have any doubts you can consult a bankruptcy lawyer.

As for the refinance, you should talk to the mortgage company about this. only if they agree, and if you have a good credit score, you can refinance.

Thanks,

Aaron

Its messed up , that i did not file the bankrupcy. I paid my debt , struglled my butt off to pay all of my debt, got sued by enyone and everyone , but honestly manned up and did what I had signed up to do. And this is a slap in the face.
I walked away from credit completely for six years other than buying some property with a cosigner three years ago, and signing on a loan with my new wife . We went through a credit union when doing it ,and didnt quiestion the high credit rating because i just assumed my credit had not bounced back just yet.

I only found that the mortgage co. was not reporting recently when a pull of my credit a month ago , and the officer asked if i had any Idea why my credit score had went from 715 to a 605 ??
It happened to be a glitch on the refinance of my property ,and a sit down with the bank fixed it almost completely over night , but only jumping my score to a 685 . Still have no idea WHy its down 30 points. I have no CC's , no late payments anywhere, and no inquiries .
Sorry to keep rambling about this subject but it just disgusts me .
I felt like I was being a standup individual taking care of my obligations and not taking the ez route out by not filing bankrupcy.
WELLS FARGO IS THE WORST!!!!

Hi dookie,

Yes, it's really distressing. I sympathize with you. However, I think you can try improving your credit by getting a secured credit card. Before taking the card do check if the credit card company reports to all the three credit bureaus. Else, your payment history won't get added on all three of your reports.

Thanks,

Aaron

My situation is similar. In November 2010, Wells Fargo sent me a notice my house was being foreclosed. I was more than three months late on payments and they were going through the process. I went down to the courthouse on December 4, 2010 to watch my house being auctioned off. What a horrible, helpless feeling. However, to my surprise, none of the four individual investors placed a bid on my house. I was stunned! Afterwords, I went up to one of the gentleman. Of course I asked him why he did not bid. The answer was: the IRS had placed a lien on my house and I owed back taxes. He said nobody was going to pay my back taxes. I knew there was a lien but never considered this would be a reason why somebody would not want to buy the house. How lucky was I!

I went home to call Wells Fargo to ask them what happened. They claimed that my home was never in foreclosure and they said I had a chance to get back on my feet. This was completely opposite of their attitude from before the auction. I know that they realize they were in a corner and their only way out was to let me get back into payments, of course, after I payed off the past due in a lump sum. The good news is, my father bailed me out to help me stay in the house. Also, I have renegotiated with the IRS and all is good making payments.

The bad news is: I tried to refinance last week and I was told that Wells Fargo has not reported any of my payments late or on time since December 2010. Since bankruptcy never came into play, why?

I don't think any of this is legal. The way they slapped me with a foreclosure, then retracted after my house didn't sell at auction.

Q: How do I get them to report on my credit report? Do I have any legal grounds about this?
