how do i answer a summons for money i owe but can not pay also my wife is not on the summons it has jane doe do i put her on the answer

If you receive a summon, you need to file an answer to it by visiting the court from where you have received the summon within the date as mentioned on it. You can file the "answer to the summon" form from the clerk's office in the court itself. If you do not file the response, the creditor can bring a default judgment against you either to garnish your wage or your bank account.

If you do not have any income or any money at bank to pay the judgment amount, the creditor can wait till you start earning and you are able to pay off the debt. This is because the creditor can legally collect the judgment amount till the SOL period on judgment expires. If your wife is not on the debt for which you received the summon, she cannot file an answer to the summon.
