had a credit card that went to collections. In Aug someone served me with a summons to Answer. I called the court and they had no idea how I should do this. I called the collector, they told me to go to the court. Called the court again, spoke to someone else, still nothing. Called back the collector and told them to put on my file that I requested a Debt Validation. Called back a week later and they said they had on File that I requested a DV and everything was on hold til then. Few months later I get my old Capital One statements in the mail. Now I get another letter from the collector saying please pay (amount they want is 1K + than original balalnce) and a copy of the old summons.
What do I do now?
Do I go down to the court and put in a letter of Answer? And send by mail another letter of DV?
How do I do the Answer??

thanks MrzFitz

Also I looked up on the NYS website and could not verify the index #. ??

In order to file a response to summon, you need to visit the court which issued you the summon and file a response with the clerk's office in the court. You may either accept or reject the charges brought against you in the answer to the summon form with reasons. After filing a response to the summon, you can send a debt validation letter by certified mail and the creditor must validate the debt first in order to bring judgment against you.
