Palisades Collection in my credit report - what to do?

definately request debt validation from them.

here is marylands information

Maryland Statutes of Limitation

Civil action: 3 years from the date it accrues, unless:

Breach of contract under any sale of goods and services under the UCC: 4 years after the cause of action, even if the aggrieved party is unaware of the breach.

Promissory notes or instruments under seal, bonds, judgments, recognizance, contracts under seal, or other specialties: 12 years.

Financing statement: 12 years, unless a continuation statement is filed by a secured party six (6) months prior to end of twelve (12) year period. (Maryland, Commercial Law article Sec. 2-725; Courts & Judicial Proceedings Article Sec. 5-101-02, 9-403).

NOTE: The 3 year statute of limitations begins again if creditors can document that a debtor has reaffirmed a debt by a good faith basis by a written agreement, orally, or by payment.

Hi Deb's old Debt
The Statute of Limitation for Maryland is 3 years for open ended accounts and since credit card falls under open ended accounts, the SOL for the debt is 3 years. However, the SOL starts from the date of your last payment towards the debt. So if the last payment towards the debt has already been 3 years then it has expired and if it has expired you should not make any payment towards the debt as if you make even a single payment, the SOL will rewind and you will be liable to pay the entire debt.

Two minor corrections...

1) The SOL starts with the first DELINQUENCY, and NOT with the last payment. Not a big difference, but collectors often wait until the last month or two to file suit on old debts, so it's imprtant that you knw.

2) No payment to a third party LEGALLY effects the SOL, because it doesn't change the SOL. Nothing changes it, not even a payment to the original creditor, the account status is not changed from "charged-off" to "open".

Yes, last delinquency is the date on which you were to make a payment towards the debt and you have not done so. The difference is generally 30 days. If the creditor files a suit within this SOL period, then you may be required to pay the debt if the creditor can provide you with proper debt validation in the court. However, even if the SOL has not expired, and the creditor cannot provide you with proper validation of the debt, then the creditor cannot bring judgment against you.

I have been trying to find a phone number on this company for two years. Nothing is listed and it seems they have just fallen off the face of the earth. Does anyone have a phone number for this company?

Oh I doubt they have fallen off the earth..We could not be that lucky. LOL. They are one of the worst collection agencies around. I have dealt with them myself a long time ago. Just look at Debs debt...1998 was over 10 years ago and the SOL has well expired if she has not made any payments. Anyway here is the info you need: Address:

I'm writing about (Powersafe Collections AKA Palisades Collection LLC).

My debt was with Chase bank in 1999, it was paid off through another credit collection agency called PDI (I have the documents to prove it).

I became part of a class action suit against Palisades [07-1398, Bettye Barker and others -vs- Palisades Collection L.L.C]. It is not even legal for them to TRY and contact me during this time.

I have reported them to the Federal Trade Commision with the above information [ftccomplaintassistant_gov] and suggest everyone does the same using their experience. It is very easy and quick .

What Palisades aka Powersafe aka Wolpoff and Anderson, is doing is buying old, delinquent, non-collectible or already paid off debt for pennies on the dollar and then trying to collect using harrassment and intimidation It is illegal.

Most of this debt has already been paid off to another collection agency who did not clear the account so they could re-sell the debt. [Hence the lawsuit] Note: in most states the statute of limitations on a debt for collection is 4 to 6 years. These scum thumb their pig noses at that law.

DO NOT SPEAK WITH ANYONE FROM THIS COMPANY. Wait for a mailed corrospondence, or issue them a Cease and Desist using the address on your credit report if they have dinged it. Also ccL the FTC and send the letter Return Receipt Requested. Never give out any information, legally it is up to THEM to prove your guilt not for YOU to prove your innocence.

Sidenote:
I have found a way of blocking their number using "Selective Caller Rejection", you might do an internet search on that and adding your mobile or telco to see if you have that feature available to you. Usually it is *60 (wait for tone) and then 866-230-8075.

Hi,

on my credit report palisades collection agency has negative record with judgement from civil court on aug 2007, as i did not receive letter from them as i was moving places. In march 2008 i called Wolpoff & Abramson somehow i got their phone number from one my banks in sept 2006, and when i called them they said i owe them around 9000 with interests etc for 8000 change.

But when i was searching on net, i found both palisades and abramsom work together(or something like that)

and they froze my citibank account and with drew all the amount in sept 2007 after judgement i suppose and i recieved letter from citibacnk stating they siezed account and debt amoutt has been doubled , any moneyput in this acocount will be taken by them.

so please suggest how can get this resolved very fast. is it better hire an attrorney, if so can you suggest good one.

or if have to do on my own how can i proceed .

I have a collection account on my credit from Palisades. It will be 7 years old in September and I have been waiting until it drops off, but we need to get a mortgage now and the bank is requesting that all of my collections be paid off -- Any ideas how to get a reduced payoff and get it cleared from my credit once it is paid?

You can get it cleared from the credit report only if you can make the creditor agree to pay for deletion agreement before you pay off the debt and get the agreement in writing. However, if the OC listing is there in your report along with the CA listing, only the CA listing will go out off your report and not the OC listing, which will stay there for 7 years and six months from the date of your last missed payment towards the debt.

800-873-5648. I have been fighting with these morons for years because I have paid off the debt they say I owe to the original creditor however they say they never recived the verification the 5 times i faxed it or the 3 times I sent it through snail mail. HMMMMM makes me wonder.

i received a notice with a threat to garnish from morgan and pottinger's law firm for a debt i owed to pallisades. it says i can avoid garnishment by sending in payments. however, i do not recall this debt nor do i recall a receiving any correspondence that i owed it or the court date...
what legal options do i have in fighting this threat...

You should pull out your credit report and find out whether there is any judgment listed there or not. If you do not find any judgment in your report, you can simply send a debt validation letter to the law firm that is calling you on behalf of Palisades. If they cannot validate your debt, you need not worry about the debt, but if they validate it, come to a repayment plan and pay it off to avoid any judgment which they may bring at a later date. But if they harass you continuously without validating the debt, you can file a complaint against them to the FTC.
