Hi,

Then you should have sent them a debt validation letter then. Under the rules of FDCPA, the collection agency is supposed to answer to the debtors debt validation. However the original creditor is not supposed to validate the debt. FDCPA does not mention that the collection agency is supposed to send the answer to your validation request within 30 days. However, the debtor is supposed to send the debt validation letter within 30 days of the first attempt of collection.

I have been getting calls from CCS for over 2 months now on my cell phone. I have told them 18 times it's a wrong number & to stop calling. Either they tell me they will take my number out or the rude rep just hangs up on me. Unfortunately for them I am a collection attorney & know the laws & direct violations they are guilty of. They use an automated dialing system (there are laws in certain states that prohibit automated dialing to cell phones). The last rep I spoke to verified that they don't check their phone numbers against any databases & don't verify if the number they are calling is a cell phone or not. They only call the numbers that their clients give them.

Hi Dave,

What you can do is send cease and desist letters to the companies through certified mail, requesting a return receipt. If this does not work, you can file complaint with the Fair Debt Collections Practices Act, and Better Business Bureau.

You will get a sample cease and desist letter with this community.

If you are not sure about this debt, you should immediately send debt validation letter to the collection agency through certified mail, requesting a return receipt.

I've received a notice from this company and don't understand it. they say I owe Liberty Mutual Insurance Co 86.00 for a unpaid bill. I didn't pay it because I went with a different insurance co. So how in the world could there be a bill when I changed to a different insurance co? I don't get it.

I have found CCS to be very understanding I was sent there by Farmers Ins. I had cancelled them in May and got other insurance and they still billed for the premium for June. The people at CCS told me what to do I will check to make sure it gets done. I also have found from talking to my current Insurance company that Farmers has done this to several of there clients. Their job is to collect debts so I would first goto them.

Actually whether a company is good or bad also depends on the person dealing with the company. Some may have good experiences with a collection agency, while some may have horror stories to share about the same collection agency.

agatha,

You can talk to your creditor about the account. If the creditor is willing to pull back the account from the collections (possible only if the account has not been sold off), you will be able to deal with the creditor himself. In that case you will perhaps be able to remove the charge-off too from your credit report.

Hey kira, i received the same letter, the credit collection services is a scam. its stating that i owe $36,000. it is impossible. I just nearly received the letter, and the accident was 2 years ago when i was 17. Its a scam.

Subject: How to Stop Debt Collectors From Calling You in Texas

Debt collector's count on the fact that most people don't know their rights about Fair Debt Collection Practices, which vary state to state. Check out your local state fair debt collection practices (just goggle it with your state's name infront of "fair debt collection practices" and it should come up).

Document, document, document every call, waht was said (as best as possible), who you spoke to, request everytime that they not callyou again, AND send them a certified letter indicating that it is your formal written request for the debt collection agency to NOT call you (but maybe mail you or e-mail you). Then, tell them in the letter you're using the cert. letter as evidence should you decide to take them to court and scare them with saying you'll ask for call recordings and records to you to be subpoenaed (that scares the poop out of them because they know it can happen Very Happy)!!!

This is a close copy of what I used to get my devt collection agency to stop harassing me AND to accept a small payment a month (they can't garnish wages in TX. Find out your states' laws about collecting). As long as a judge sees that you are trying to repay your debt in good faith, it looks good. Enjoy!!!

Northstar Location Services,

To Whom It May Concern:

This letter is to certify and document that any necessary action will be taken against Northstar Location Services, LLC should they contact me again via telephone, or any other communication medium other than air-mail. I formally request to be removed from Northstar Location Services, LLC calling list and ask that they only communicate with me via mail. Representatives are not allowed to phone me regarding my past due account. It is not necessary for one to request in writing that a debt collection company stop making contact. One must only ask the representatives to stop calling (and only contact via air mail), as I have done REPEATEDLY, but the representatives continue to call me, repeatedly violate Fair Debt Collections Practices.

The request in writing is only used as evidence for the customer/client to later prove in court (apart from calling records and recorded calls that the company possesses) that the individual can use in court. It is not necessary to have a written request for the Fair Debt Collections Practices Act to be enforced (the writing only serves as evidence on the part of the individual being contacted).

I have communicated to Northstar Location Services, LLC that I have gone through periods of unemployment, part-time employment, and/or have been making a wage that does not allow me to make payments as high as Northstar Location Services, LLC demands (of about $335 a month).

I will make a monthly payment of $100. per month, and if I am able to renegotiate a higher payment plan or a settlement plan with them in the future, I will contact them to do so; however, this agreement is only with the understanding that Northstar Location Services, LLC WILL ALSO PROVIDE IN WRITING THAT IT WILL REMOVE THE BAD DEBT/CREDIT REPORT AGAINST MY CREDIT REPORT AFTER I REPAY THE DEBT. It is critical that the company adhere to this request (whether I pay $100. a month or repay the debt through a settlement with the company).

I have offered trying to pay about $100. per month in reference to this debt that Northstar Location Services, LLC has purchased from Bank of America, but it has been communicated/implied to me that it is not enough for the company to accept and that they are going to take formal legal action against me to collect the debt. I am well aware that it is in my best interest to pay this debt and not have a judgment of debt collection placed against me, but this is the most I can offer at the moment, though I truly wish and intent to repay this debt.

Northstar Location Services, LLC representatives have called me repeatedly, even after I CLEARLY indicated that they may not do so. The Federal Trade Communications Complaints Department communicated that I may take action against them immediately because any calls that they make to me after I have requested that they stop contacting me (which I did in August of 2010) that I consider annoying, inconvenient or harassing, as defined by me, enables me to take legal action against them, as the laws permit in the state of Texas (though the company is located in NY). If this request is not abided to, please expect to hear from the FTC shortly in reference to this matter. I will be asking that Northstar Location Services, LLC’s telephone records be subpoenaed to further prove that Northstar Location Services, LLC violated the Fair Debt Collections Practices Act. I greatly appreciate your cooperation in this matter
