I don't believe this is identity theft, as the OC has no knowledge of this account and this is the only negative/inaccurate account on my CR; this CA has a long-standing reputation of reporting innacurate information and is just an all-around headache. Experian continues to verify the information as accurate, and I really don't want to pay this shady CA for something I don't owe... I'm really at a loss here, especially if I am indeed incorrect on the DV period... |

It is not true that that the collection agency has 30 days to validate the debt. There is nothing in the law which states the time limit that a collection agency has, to respond to a dispute in question. |

cinnamngrl, not upset at all and I sincerely appreciate your help.
It's been reported since around November or so of last year. I did indeed file a claim online with my AG and they sent me a letter stating that my claim was better handled by another agency. This was over a month ago and nothing has happened since.
This CA has called my work and told coworkers, including my boss, that I write bad cheques, that I am going to jail, has yelled/sworn/etc to myself and others... Sigh. It's a mess.  |

Not sure how I could possibly document it, it would basically be a he said she said situation. I was sitting next to my boss when he spoke with the rep from the CA and heard the terrible things he said, but without a recording I'm not sure what I could possibly prove here. The CA also told me that I was writing bad cheques, would be going to jail, and went so far as to misrepresent themselves as the IRS stating that I owed the money for back taxes. Of course, I can't prove this.
The AG said they sent this information to an agency with the name "Financial" in it... I cannot remember off the top of my head and do not have the letter handy. |

ETA: I never did receive a debt validation letter from the CA, but today I got a settlement letter for 50%..... Not sure what to think about this one... |

Yep..I have a few debts, on my CR, that are inaccurate. The CA's are reporting them wrong!! I've tried calling the CA's and the CB's. The CA's tell me they are not "obligated to send me any kind of paperwork I'm asking", and the CB's say they have to report what the CA's 'validate'. The entire process was a pain!! |

sdchargers, so what did you do? Experian won't remove anything and are a PITA to deal with in the first place. When I asked them what the heck it is that they were verifying with this particular CA, they wouldn't tell me.
I am wondering if I should just give this POS CA their measley hundred bucks in exchange for a pay for delete and just move on... Sigh. |

there is no 30 day limit .. the way to make this work to your advantage ... if CA does not validate .. dispute with bureaus ... if they verify .. they're in violation of the FCRA ... verifying the debt is considered "continuing to collect" |

Per FDCPA burden of proof lies on the debtor! the CA has proof of debt in documentation provided to them by the lendor all the time. You have to show them it wasn't you and you don't owe within 30 days. Not the other way around. They justy have to show and explain the debt claimed! Federal guidelines over ride your state! |

Fact is that most of the complaints I see in these forums are people that DO owe the bill and just don't want to pay it. Any CA is just doing a job and trying to make a living. Simple fact is if you owe it work it out and mostly you can wheel and deal and settle to pay less than you owed. If it really isnt your bill then show them where your id was stolen or that they have incorrect information about you and move on with life of paying bills that you do owe! |

I have found out that this company is not licensed in Ohio and I do have a payday loan that was turned over to them but what options do I have as far as payment arrangements. Thay are very very nasty |

If the collection agency is not licensed in your state, then you don't have to make payment arrangements with them. Who is the payday loan lender? |
