Hi All,

I filed bankruptcy in 9/2005 and it was discharged/reported 3/2006.

BUT.... there is a judgment on my reports thats related to the bankruptcy from one of the lenders? Details as follows:

Equifax:
under closed accounts it shows a loan (unsecured):
"Included in bankruptcy" "Bankruptcy chapter 7 discharged"

Under public records it shows:

The bankruptcy of course
and
The loan!!!
Details are as follows:

Date filed: 3/2006
Case #: XXX
Court Address: 14 Livingston
Plaintiff: the Lender
Defendant: me

Status: (shows nothing)
Date Reported: N/A

Transunion:
Pretty much the same details except the type has "civil judgment" and estimated date that this item will be removed is 2/2013.



Why is this? is this a mistake? I just want to learn more before i move forward. Thanks for all replys and help.

Hi Guest,

If the bankruptcy has been discharged, then it must be mentioned in the credit report. It might be an instance of inaccurate information n your report. You can either call the credit bureau and clarify it with them or write a dispute letter asking them to update the information properly on your credit report. A judgment stays on your report for 7 years, just like any other negative item. However, you can always dispute if you think that the status has not been reported properly in your credit report.

I think my original post might have been a bit misleading, let me clarify. The bankruptcy IS mentioned on my reports as discharged. My confusion is regarding a civil judgment for a loan that was discharged in the bankruptcy. The bankruptcy was filed 9/2005, discharge date 3/2006, civil judgment was filed 3/2006, with no date reported or satisfied date.
So, I want to understand why that judgment is on my credit report and what does that mean with no dates? Is it resolved or not? It was discharged though?
BTW: I recieved the bankruptcy discharge settlement form and I'm awaiting that decision. Is it due to that issue that they sent me that form?

I believe it is suppose to say included in bankruptcy 0 balance. Try disputing it with the credit agencies first and if that doesn't work dispute it with the original creditor. It could be they haven't received the proper papers and haven't updated it in their system. I had one that was reported as a charge off and I disputed it for two months before the original credit would correct it. If you run into that happening let me know. I can tell you the next step to take to get it corrected.

I would like to believe that it is for the same issue and vice versa. Unless that is settled your status cannot be updated. I suppose you had filed the bankruptcy against the judgment right? If that is so, then you must dispute it with the bureau telling them that the bankruptcy related to that judgment has been discharged. If it for some other reason, then also you can dispute the date since it is inaccurate.

You need to go to the court house have them look up the judgment and give you further information on the status. If it is showing that you owe, you need to inform them that it was included in bankruptcy and that it need to be dismissed. Hopefully dismissed - that way you can get a copy of that form and forward it to the credit reporting agencies with request for deletion.

I filed for chapter 13 protection in Dec 2001. I complied with the terms of the bankruptcy to the T. After the fourth month I received a letter from the court stating that I was no longer under the protection of the court because some paperwork ( my income tax return) was not filed in a timely manner. Needless to say, all the creditors resumed their collection tactics. I ended up losing our home, cars, etc. It's 10 years later and time to clean up this mess. On my credit reports the banruptcy shows up as discharged with a removal date of Nov 2011. I can't wait for that. I would appreciate any input. Can I dispute the bankruptcy itself appearing on the credit report? Basically I got the stigma of turning to bankruptcy court when I did not even receive any of their services. Aloha, A.

Hi anthony,

I am really feeling sorry for the situation you have gone through. But, you could have re-filed the bankruptcy within 180 days of the first dismissal of bankruptcy.

However, I am afraid that you can't remove the bankruptcy before 2011. It is there to stay for the stipulated time.

From the information that you are providing it sounds as if this judgment was reported after your bankruptcy case is filed. From my point of view the creditor cannot report it after you have filed your bankruptcy case. Once your bankruptcy case was filed they should not be reporting derogatory information on your credit report. Although a judgment can remain on your creditor report for 7 years, in this instance it was reported after your bankruptcy case was filed.

I disputed a discharged bankruptcy and they sent back my card, original letter and a copy of the discharge papers. Is it impossible to get this negative thing off of a credit report?Do someone have a letter that they used that actually worked?

Hello Guys before working with COLEFRANKSERVICES I had a credit score of 531 to 542. I went looking for a loan from Metro Credit Union and they told me to pay my debt to Bank of America first which was about $4,800. At the time my credit report was awful with red mark all over it.
