Accounts in collections

Hi,

My question involves collection proceedings in California. I have credit card debt with various banks and I haven't been able to pay them in 6-7 months. Most debts are still held in house, some have been charged off and assigned to other law groups and collection agencies.

Do I have any time without making payments before they actually do asset searches and take legal action?

Hi Bertina,

Actually there is no certain time within which creditors and collection agencies may sue you for unpaid debts. I think it is better to negotiate a repayment plan rather than letting them take you to court. What your creditors and collection agencies want is their money. So, if you agree to pay them their dues, they will not sue you.

In regards to the collection agencies did you send debt validation letters to them?
