wells fargo collection department

Submitted by Anonymous (not verified) on Wed, 07/29/2009 - 05:52

I owned a small s corp biz for two years with a friend. I left the business and my partner was late with the payments on the company's wells fargo credit card which I had taken out for the business. Apparently there was an ultimatum for payment which I never learned about (they stated they couldn't get in touch with me) and last January the WF collection department took $3700 out of my personal checking account. Upon learning of this, I called and worked out a payment plan for by ex biz partner who has been paying on a monthly basis as soon as he gets paid from his job.

how are debts validated?

I was just wondering, how much proof should I need before paying a collection agency? I talked to a lady over the phone and she said she'll send me a letter regarding my debt before I can make payments and all she sent me is a letter stating

my original creditor
my account #
the breakdown of my debt
confirmation (without proof) that they are authorized agents acting on behalf of the named client

is this enough validation?

Debt consolidation - an economical way to get out of debt

Hi,

A lot of people today are experiencing heavy debt burdens, and the numbers are rising day by day. Debt consolidation is the most economical way to get out of debt, as instead of many payments to various creditors, the debtor will make only one.

I'm being sued by Gamache & Myers PC.

There was a sheriff's officer that brought the summons to my home this afternoon, 7-19-09 (on a Sunday is weird). Anyway, it was signed by a county clerk on 6-26-09 (23 days ago). On the summons it states that it was to be served no less than 10 days, or more than 30 days prior to the court date. Court is set for this Tuesday, 7-21-09 (2 days). Also, he gave it to my husband instead of me, didn't fill out ANY of the info regarding his name and signature, who he served it to, where it was served, or the date and time.

Should I still send debt validation if...

I am the one that approached the collection agency? I called my original creditor, which was a bank and they said they've transferred my account to a collection and gave me a number to call. I called it, and all they asked for was my full name and said I owe them this much (which was pretty much on the dot).

Should I still send a debt validation at this point or can they be fully trusted since it was the original creditor that gave me their number?
