Appointment with lawyer has been set to prepare response to summon. I'm going to ask lawyer to use affirmative defenses since DV letter was not answered. I hope this will have some weight in court.
What would happen if CA come up with DV documents at the hearing? Would this throw out their responsibility of need to validate debt in reasonable amount of time per Fair Credit Act? After all, they did not respond to my DV letter, not once but twice. And waited all these time to accumulate interest so that they can collect more money for the interests. This is just wrong!
What's there to lose anyway. Got to try all I can to reduce or dismiss the charge.
