I am trying to refinance a vehicle I helped my ex get to remove him since he was unable to refinance into his own name and he refuses to sign the release of liability for me to finish the refinance. What can I do?

I got a car for me and my husband. We no longer togther and he is the co signer on the loan. I'm the borrower of the money and his name is the only name on the title. Would I be able to take him to court and get my name remove. He is behind on his payment and it's affecting my credit. How do I go about legal action or get myself out this mess.
