I received a summons from CitiBank. First of all CitiBank charged this off. So it looks like CitiBank is suing me. The paper work at the top shows SUMM , then a lawyers name and address. Not sure who I am dealing with.

It also says to reply within 20 days to Distric Court a formal written response to the Complain in accordance with the rules of the court, with the appropriae filing fee. The filing fee is $223.00. Which I don't have. What do I do now? Not answer and wait for a judgement?

I was working with a debt settlement company and they dropped the ball on CitiBank. I wanted to settle with this company first, but they went ahead and settled with another company. So now I am being sued by CitiBank.

Hi MG,

You say that you have received summons from Citibank. However, in the very next line you've mentioned that this debt has been charged off. So, you need to first check out from your credit report as to who now holds the account.

As for the summons, you need to answer to that, else the creditor or collection agency will win a default judgment against you. Then you will have to pay that default judgment amount. If you don't have the money, you can try to get it from your relatives or friends.

That is what was in my original message.

I am assuming I am dealing with the law company.

I am not sure why I have to pay $223.00 for a filing fee, to answer a suumons from the law company, and if I do answer it without a filing fee, will it be rejected by District Court?

Hi MG,

If the debt has been charged off that means the creditor is no longer interested in collecting the dues. Now, as they are suing you for the debt even after charge-off, I think they are wanting you to pay. As you have received the summons you need to answer to that, and appear in the court on the stipulated date.

However, regarding the charge-off, and preparing the answer to the summons, and the filing fee you can consult an attorney.
