I have found out I am being taken to court for an old credit

I founf out through a letter sent by Peter Francis Geraci and a Wisconsin Debt consolidation agency that I have a court date on Jan 25. I verified this in the Wisconsin Circuit court records. I called the clerks office and they said indeed this was true. I have NOT received the summons. However I DO have the attorneys name. The company is called Currahee Financial LLC. I was irresponsible in my younger days and got deep into debt. I would be willing to settle. But I'm nervous about contacting the attorney and paying too much. I've read on here about debt validation letters. Should I do this first. The court date is Jan 25 2010 so it is within that 30 day limit i read about. Please help.

Yes of course you can ask for debt validation. If you are not sure about the debt, you must ask the CA to validate. Once the CA has validated the debt you can ask for settlement. In court you will have a chance to prove that you are in a financial hardship for which reason you are not being able to pay up. So, don't worry, something can be worked out soon.

Good idea to ask for Validation. However........the OP never received a Summons? CAROL....if she never received a summons, is the OP obligated to go to court?

I recieved the summons last night. I would like to settle, but am not confident in my negotiating ability with a lawyer. I am currently helping my mother through some medical issues so anything I can spare would be helpful. Should I ask for validation first and then negotiate?

Yes you ask them to validate the debt before you negotiate. They have to send you proof the debt belongs to you first.

I asked for validation and they sent me the name of the credit card company, and the loan number. This debt was due to identity theft. I was living out of the country for 17 years and didn't take out the debt. Is the name and loan # enough for validation?

No it's not they could have made that up. I would request a copy of the original contract signed by you.

Hi Susan,

I absolutely agree with debranewell. As an answer of your debt validation letter, you should be provided with the original copy of your contract with the company, mentioning all the details. Only the name and loan number is not enough to prove that your debt is valid.
