bank account levied

In NC can bank accounts be levied after a judgment? I have a credit card debt and I know that there is no wage garnishment for CC debt. I know this that accounts can be levied for taxes and child support but can they be for credit cards? Though there is no judgment against me as of now, I fear that I will get sued. What can I do? I don't have much money to make the payments.

Hi Dedalus,

Whether or not bank account can be levied depends on the state laws. As far as I know in North Carolina, the creditor is required to serve a Notice of Right to Claim Exemptions before he can levy the bank account of the debtor.

However, you can try to negotiate a settlement with the creditor. Debt settlement lowers the outstanding debt amount by 40-60%. Thus, it gets much easier to pay. Rather than allowing the creditor to drag you to court and levy your bank accounts, you can try for the settlement.

Hope this helps.

Aaron
