Medical Debt Questions

Hello all,

I hope that someone can help me. I have an $8k medical debt from 10/15/04. It isn't that I am unwilling to pay, just unable at this point. Recently, I have received threatening letters from a collection agency. The most recent letter states that they will assign my account to their "assets investigation department" and check my:

-credit bureau file
-bank accounts
-employment
-motor vehicle registration
-other procedures

Can they verify all my assets without having a judgement against me? The other question is, this is coming up on the 6 year mark in October. I have not been successful in determining whether the state of Arizona considers medical debts open or written contracts, so I'm not sure if the SOL has expired already or will expire in October. The SOL in AZ for open contracts is 3 years, SOL for written contracts is 6. Should I lay low until October when the SOL has FOR SURE expired, or what should I do here? Again, I am not avoiding this debt - I just cannot pay it immediately and do not want to be sued. I am thinking that this is a scare tactic by the CA seeing as they let this go for all these years, but I am not sure...

Medical debts are closed ended accounts, and thus comes under the Statute of Limitations. Arizona considers medical debts as written contracts. The statute of limitations for closed ended accounts or written contracts in Arizona is 6 years.

I wouldn't say that it is a scare tactic, the fact that the SOL is expiring in Oct is why they beefing up their efforts. they don't have get the judgment before Oct, they just have to file the case.

Laying low is an option but it may not work. One option would be offering a settlement. Suing is much worse. judgments can stay your record for 20 plus years.

So have you sent a DV letter?
