Settlement PFD

Hi,

I have been DVing and PFDing non stop the past few months with all my thanks going to this forum. However, I cannot even get a response from the collection agency. I have CMMR and I also emailed a PFD every other day to the collection agency and have not heard a word. I received a settlement in the mail and then re-used it to have a deletion, but I haven't heard anything.

My question is what should I do? Obviously they have my info and want me to pay given the settlement offer, however I have emailed and mailed plenty of times and have had no response to my PFD letters? Should I just give in to the settlement?

Advice please?

Hi Sian,

As far as I understand from your query, the collection agency has not validated your debt. Thus, they cannot send you settlement offer. Without validating the debt a collection agnecy cannot continue with the collection process. If they do, then it will be the violation of Fair Debt Collections Practices Act.

You should never agree to any kind of payments till they validates the debt.

This a MOV situation. YOu should write a letter asking them how they are reporting this tradeline when the source will not respond to your inquires. Send copies of your green cards. there is an article with more detail at my web page.

do you have all your credit reports?
what state are you in?
what is the original creditor and the name of the CA?
what is the date of first delinquency? 30 days after last payment

Aaron is correct on this. And also be aware that you probably need to keep each letter they send you in their collection efforts. Each letter and each phone call from them is a potential $1000.00 fine. So log all calls and keep letters and get a lawyer to sue and watch how fast the CA will want to come to an arrangement!
