Problem with 7 year old unpaid medical bill

Hi,

I am trying to fix a credit issue regarding an unpaid medical bill. This occurred in 2003. I had to move shortly after this and so never received a bill, until today from the collection agency.

Now the collections agent is presenting me with this 7 year old bill, and more than twice in amount due to interest. I talked with the creditor and asked them to give me the original amount and work out a plan. But they said no. And it is on my credit report. It is in WA.

While I am sure I had to sign something leaving the emergency room I thought in this state that interest could not be assigned unless agreed to in writing to a debt.

1. First try to validate this debt with the collection agency. Send the debt validation letter through certified mail, requesting a return receipt.

2. Check if the Statute of Limitations (SOL) on this has expired.

3. If the collection agency fails to validate the debt and if SOL has expired, dispute this item off your report and send a cease and desist letter to the collection agency that the SOL on this debt has expired and you are aware of your rights.

4. If the SOL has not expired and the debt comes back validated, get a payment agreement with the collection agency. Also keep proof of your payment. According to a new rule the collection agnecy is supposed to remove the negative on a medical debt once the debt gets paid off.
