I have a legal store payday loan in TN that I defaulted on 3 yrs ago. It has be add as a debt on my credit report. Last week, in standard mail, I received a "summons" tri- folded type (a copy of a real summons that they filled in with my info) that I pay or in 5 days or they will issue a warrant. I know I owe the debt but is this form of collection legal. They have also left voice-mails at my parents and brothers home numbers that I have written"Bad Checks" and need to contact them. Thanks for all your help, B

Well, if you have been asked to appear at the court, you should never avoid it. If you avoid it, then the other party might just win a judgment against you.

A default judgment could be achieved by them. A court might order you to repay your debt. An Arrest warrant can't be issued. However I've heard about a 'warrant of execution' that gets issued by the court when you don't repay your debt as per the order of the court. With this warrant of execution, the bailiffs of the county court will try to recover your debt. In reciprocation, you may also request the court to get this warrant suspended.
