I had a Visa credit card through Capital One with a 5,000 dollar credit limit. I defaulted on 3,500 dollars, and Capital One charged off my account and sold my debt to a collection agency. I know this from my prior credit report. Now, 4 years later, I am being sued by Capital one for 12,000 dollars, mainly due to late fees and interest. Is this legal? If so,what options do I have? Thank you for your time and answers.

You may ask them to get your debt validated. This way you'll come to know the source of your debt. If you come across some thing that you don't agree with, then you have the right to request the bureaus to get it validated. Make sure that you be there in the court on the date and time mentioned.
